OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Active Transit, dated March 17, 2021 and pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act and pursuant to

Section 11 of

Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, is pleased to: (

a) extinguish the right of the public to use that portion of the public highway, identified as Lot 2020-1, containing an area of 90,102 square feet, more or less, located at or near Westmount, Cape Breton County, more particularly described in

Schedule “A” and shown on

Schedule “B” attached to and forming part of the Report and Recommendation; (

b) authorize the conveyance of Lot 2020-1 to Bruce Barnaby of Westmount, Cape Breton County for the consideration of $31,050.00, plus $4,657.50 HST; (

c) authorize the Minister of Transportation and Active Transit to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the land, and; (

d) authorize the Minister of Transportation and Active Transit to execute such documents as may be necessary to achieve the purpose of this Order.
