OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated December 10, 1999, pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to: (

a) extinguish the right of the public to use that portion of the public highway system containing 3.12 acres, more or less, of the old White Rock Road and 5.61 acres of surplus Departmental lands, situate at or near Canaan, Kings County, and more particularly described in

Schedule "A" and shown outlined in red on

Schedule "B" which schedules are attached to and form part of the report and recommendation; (

b) convey the said 8.73 acres of land to Rudolph Burghardt and Marilyn Burghardt of Canaan, Kings County, in exchange for other lands required by the Province, reserving the brook as shown on

Schedule "B"; and (

c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.
