Section 1 of the Public Works Act,

chapter P-28 of the Revised Statutes, 1973, is amended 1 L’article 1 de la

a) in the English version of the definition “public work” by striking out the period at the end of the def- inition and substituting a semicolon;

b) in the French version of the definition “proprié- taire” by striking out the period at the end of the def- inition and substituting a semicolon;

c) by adding the following

definitions in alphabet- ical order:

section 8 the fol- lowing: 4 La Loi est modifiée par l’adjonction de ce qui suit après l’article 8 : 8.1 The Minister may, by himself or herself or by his or her architects, engineers, agents and workers, enter any building or on any land that is, for the purposes of a project, designated as a public work by the Minister in order to carry out work on that public work. 8.1 Le Ministre lui-même, ses architectes, ses ingé- nieurs, ses représentants et ses ouvriers peuvent pénétrer dans tout bâtiment ou sur tout bien-fonds qui, pour les be- soins d’un projet, est désigné ouvrage public par le Mi- nistre en vue d’y effectuer des travaux relativement à cet ouvrage public. 5 The Act is amended by adding after

section 9 the fol- lowing: 5 La Loi est modifiée par l’adjonction de ce qui suit après l’article 9 : 9.1 Before the Minister designates any land or building as a public work for the purposes of a project, the Minister shall serve notice in writing of the intention to designate on the owner of the land or building. 9.1 Avant que le Ministre désigne ouvrage public un bien-fonds ou un bâtiment pour les besoins d’un projet, le Ministre signifie un avis écrit de l’intention de désigner au propriétaire du bien-fonds ou du bâtiment. 9.2(1) A notice under

a) the Community Planning Act,

b) any by-law enacted under the Community Plan- ning Act,

c) any regulation, order or demand made under the Community Planning Act,

Loi sur l’urbanisme. 9.4(1) Despite any other Act, the Minister may apply for any permit, licence or approval that he or she considers necessary to carry out work on the lands and buildings that are, for the purposes of a project, designated as public works by the Minister. 9.4(1)

Section 11 of the Act is repealed and the following is substituted: 6 L’article 11 de la Loi est abrogé et remplacé par ce qui suit : 11(1) If the Minister does not agree with the compensa- tion claimed under subsection 10(2), the Minister shall, within 60 days after receiving the claim for compensation, offer in writing the amount that the Minister considers to be reasonable compensation and at the same time give no- tice to the person claiming compensation that if the amount of the offer is not accepted within 60 days after the date the person receives the offer, the matter of compensation will be submitted to arbitration. 11(1) S’il s’oppose à l’indemnisation réclamée en vertu du paragraphe 10(2), le Ministre offre par écrit, dans les soixante jours de la réception de la demande d’indemni- sation, l’indemnité qu’il juge raisonnable et, en même temps, avise la personne réclamant l’indemnisation que, si le montant offert n’est pas accepté dans les soixante jours de la réception de l’offre, la question de l’indemnisation sera soumise à l’arbitrage. 11(2) If the person claiming compensation does not ac- cept the offer of the Minister within 60 days after receiving the offer, the Minister shall submit the matter of compen- sation to arbitration and the Minister and the person claim- ing compensation shall be deemed to have entered into a written arbitration agreement. 11(2) Si la personne réclamant une indemnisation n’ac- cepte pas son offre dans les soixante jours de sa réception, le Ministre soumet la question de l’indemnisation à l’ar- bitrage et la personne réclamant l’indemnisation et lui sont réputés avoir conclu une convention d’arbitrage écrite.

7 The Act is amended by adding the following after

section 11: 7 La Loi est modifiée par l’adjonction de ce qui suit après l’article 11 : 11.1 The Arbitration Act applies to an arbitration under this Act but, when there is a conflict between a provision of this Act and a provision of the Arbitration Act, the pro- vision of this Act prevails. 11.1 La

Loi sur l’arbitrage, la disposition de la présente loi l’em- porte. 11.2(1) An arbitral tribunal has exclusive jurisdiction to hear and determine all matters of compensation under this Act and no court shall intervene in the matter of compen- sation, except for the following purposes: 11.2(1) Un tribunal d’arbitrage a compétence exclusive pour trancher les questions d’indemnisation prévues par la présente loi et aucun tribunal judiciaire ne peut intervenir dans ces questions, sauf aux fins suivantes : (

a) to assist the arbitration process;

a) faciliter le processus d’arbitrage; (

b) to prevent unfair or unequal treatment of a party to an arbitration agreement;

b) empêcher qu’une

partie à une convention d’arbi- trage soit traitée injustement ou inéquitablement; (

c) to enforce awards.

c) exécuter les sentences arbitrales. 11.2(2) No person shall apply for compensation under

Part II of the Expropriation Act or any other Act for dam- ages suffered by virtue of anything done under this Act. 11.2(2) Il est interdit de présenter une demande d’in- demnisation en vertu de la

Loi sur l’expro- priation ou de toute autre loi pour les dommages subis par suite de tout acte accompli en application de la présente loi. 11.3(1) Within 10 days after the date on which the Min- ister submits the matter to arbitration, the Minister and the person claiming compensation shall appoint a sole arbi- trator. 11.3(1) Dans les dix jours de la date que le Ministre soumet la question à l’arbitrage, ce dernier et la personne réclamant une indemnisation nomment un arbitre unique. 11.3(2) If the Minister and the person claiming com- pensation are unable to agree on the appointment of a sole arbitrator within 10 days after the date on which the Min- ister submits the matter to arbitration, an arbitral tribunal consisting of 3 arbitrators shall be appointed as follows: 11.3(2) Si le Ministre et la personne réclamant une in- demnisation ne peuvent s’entendre sur la nomination d’un arbitre unique dans les dix jours de la date à laquelle il a soumis la question à l’arbitrage, un tribunal d’arbitrage composé de trois arbitres est nommé comme suit : (

a) one by the Minister;

b) one by the person claiming compensation; and

c) one by the arbitrators appointed under paragraphs (

b) who shall act as chair of the arbitral tribunal.

11.3(4) If the Minister or the person claiming compen- sation fails to appoint an arbitrator within 10 days after the expiration of the time period referred to in subsection (2), The Court of Queen’s Bench of New Brunswick shall appoint an arbitrator on behalf of the Minister or the per- son, as the case may be. 11.3(4) Si le Ministre ou la personne réclamant une in- demnisation omet de nommer un arbitre dans les dix jours de l’expiration du délai imparti au paragraphe (2), la Cour du Banc de la Reine du Nouveau-Brunswick nomme un arbitre pour le compte du Ministre ou de cette personne, selon le cas. 11.3(5) If the arbitrators appointed under paragraphs (2)(

a) and (

b) are unable to agree on the appointment of the chair within 20 days after the appointment of the sec- ond arbitrator, The Court of Queen’s Bench of New Bruns- wick shall appoint the chair on their behalf. 11.3(5) Si les arbitres nommés en vertu des alinéas (2)

a) the Minister is responsible

i) for the fees and expenses of the chair, (

i) les honoraires et les frais du président, (ii) for the fees and expenses of the arbitrator ap- pointed by the Minister, and (ii) les honoraires et les frais de l’arbitre qu’il a nommé, (iii) for any other expenses related to the arbitra- tion, and (iii) tous les autres frais connexes; (

b) the person claiming compensation is responsible for the fees and expenses of the arbitrator appointed by that person.
