chapter L-10 of the Re ‐ vised Statutes, 1973, is amended by adding the follow ‐ ing after

section 136: 1(1) La

definitions apply in this sec ‐ tion. 136.1(1) Les définitions qui suivent s’appliquent au présent article. “associate of a gang” means a person who supports, facilitates, is involved in, participates in or contributes to the unlawful behaviour of a gang. (collaborateur d’une bande) “gang” means a group of persons who engage in a pattern of unlawful behaviour or in creating an atmos ‐ phere of fear or intimidation in a community. (bande) “unlawful behaviour” means (

a) the production, sale, importation, exportation or trafficking of a controlled substance as defined in the Controlled Drugs and Substances Act (Canada), (

b) obtaining sexual services for consideration, pro ‐ curing a person to offer or provide sexual services for « activité illégale » S’entend de ce qui suit :

consideration or receiving material benefits from sex ‐ ual services provided by another person for considera‐ tion, (

c) unlawful possession or transfer of firearms, or (

d) violence, threats, extortion or intimidation. ( acti‐ vité illégale)

(associate of a gang) 136.1(2) A peace officer may demand any person the peace officer has reasonable grounds to believe is a member of a gang or an associate of a gang to leave a licensed premises, and if the person fails to leave the li ‐ censed premises, the person commits an offence and the peace officer may eject the person from the licensed premises. 136.1(2) Tout agent de la paix peut ordonner à toute personne dont il a des motifs raisonnables de croire qu’elle est membre ou collaborateur d’une bande de quitter un établissement titulaire d’une licence, auquel cas, si cette dernière n’obtempère pas, elle commet une infraction, et l’agent peut l’en expulser. 136.1(3) In determining whether a person is a member of a gang or an associate of a gang, a peace officer shall consider, among other things, the following: 136.1(3) L’agent de la paix tient compte notamment de ce qui suit lorsqu’il détermine si une personne est membre ou collaborateur d’une bande : (

a) whether the person is present at the time an un ‐ lawful behaviour of the gang takes place and the peace officer has reasonable grounds to believe that the person participated in the unlawful behaviour;

b) whether the person admits to being a member of the gang or an associate of the gang;

Section 20 of New Brunswick Regulation 84-265 under the Liquor Control Act is repealed and the fol ‐ lowing is substituted: 2(1) L’article 20 du Règlement du Nouveau- Brunswick 84-265 pris en vertu de la

Loi sur la régle ‐ mentation des alcools est abrogé et remplacé par ce qui suit : 20(1) No licensee shall permit disorderly, boisterous or intoxicated persons to be in the licensed premises, permit the use of profane or vulgar language in the li ‐ censed premises or use profane or vulgar language in the licensed premises. 20(1) Le titulaire d’une licence ne peut ni permettre qu’une personne ait une conduite désordonnée ou bruy ‐ ante ou se trouve en état d’ébriété dans son établissement titulaire d’une licence, ni y employer ou permettre qu’y soit employé un langage vulgaire ou blasphématoire. 20(2) No licensee shall permit any activity in the li ‐ censed premises that 20(2) Le titulaire d’une licence ne peut permettre qu’ait lieu dans son établissement titulaire d’une licence une activité qui : (
