Statute: Public Highways Act Expropriation Act

OIC Text: The Governor in Council, on the report and recommendation of the Minister of Public Works dated December 5, 2023, and pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and

Section 80 of

Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act , is pleased to: (

a) extinguish the right of the public to use that portion of the public highway, identified as Lot 23-1, containing an area of 5,062.5 square metres (1.25 acres), more or less, located at or near Kearney Lake Road, Halifax County, more particularly described in

Schedule “A” and as shown on

Schedule “B” attached to a forming part of the Report and Recommendation; (

b) authorize the conveyance of the parcel of surplus land, Lot 23-1, to Gever Developments Limited of Halifax, Halifax County, for the nominal consideration of $1.00, in exchange for Parcels A and C, owned by Gever Development Limited, and any interest in Parcel B, to be conveyed by quit claim deed, more particularly described in

Schedule “C” and shown on

Schedule “B” attached to and forming part of the Report and Recommendation; (

c) authorize the Minister of Public Works to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the lands herein above described; and (

d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purposes of this Order.
