An Act to Amend the Police Act Loi modifiant la

Loi sur la Police Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1

Section 25.03 of the Police Act,

chapter P-9.2 of the Acts of New Brunswick, 1977, is amended 1 L’article 25.03 de

chapitre P-9.2 des Lois du Nouveau-Brunswick de 1977 est modifié (

a) in subsection (1) in the portion preceding para- graph (

a) by striking out “Notwithstanding” and sub- stituting “Pending the outcome of proceedings taken under this Part and notwithstanding”;

a) au paragraphe (1), au passage qui précède l’ali- néa a), par la suppression de « Nonobstant » et son remplacement par « En attendant les résultats des pro- cédures engagées en application de la présente

partie et nonobstant »; (

b) in subsection (2) by striking out “during the pe- riod of suspension” and substituting “but for the sus- pension”;

b) au paragraphe (2), par la suppression de « pour la durée de la suspension sans traitement » et son remplacement par « n’eut été de la suspension »; (

c) by adding after subsection (2) the following:

c) par l’adjonction, après le paragraphe (2), de ce qui suit : 25.03(3) After the conclusion of proceedings taken un- der this Part, the member of a police force or the chief of police, as the case may be, shall receive all of the pay, remuneration, benefits and seniority to which the member of a police force or the chief of police would have been entitled but for the suspension less any pay, remuneration, benefits or seniority the member of a police force or the chief of police is not entitled to as a result of a sanction imposed in accordance with subsection 26(9) or (10). 25.03(3) À l’issue des procédures engagées en applica- tion de la présente partie, le membre d’un corps de police ou le chef de police, selon le cas, doit recevoir la totalité du traitement et de la rémunération et bénéficier des avan- tages et de l’ancienneté auxquels il aurait eu droit n’eut été de la suspension, déduction faite du traitement et de la ré- munération retenus, des avantages refusés et de l’ancien- neté non reconnue en raison de l’imposition d’une sanction conforme au paragraphe 26(9) ou (10). 1
