SUMMARY CONVICTIONS AMENDMENT ACT, 1983 (Assented to , 1983) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: 1 The

Summary Convictions Act is amended by this Act. 2

Section 1 is repealed and the following substituted: 1 In this Act, (a) "justice" (

i) means a justice of the peace, and (ii) includes 2 or more justices sitting and acting together, a provincial judge, and every other officer or functionary having, for the purpose of any Act, the authority of a justice of the peace or provincial judge; (b) "peace officer" includes a park warden appointed pur suant to the National Parks Act (Canada), while he is in the exercise or discharge of his powers or duties in a national park estabhshed under that Act. 3(1) The Highway Traffic Act is amended by this section.

(2) Section l(o.

l) is repealed and the following substituted: (o.l) "peace officer" means (

i) a member of the Royal Canadian Mounted Pohce, (ii) a member of a municipal police force, (iii) a special constable, (iv) a patrol officer of the Department of the Solicitor Gen eral, or (

v) a park warden appointed pursuant to the National Part Act (Canada), while he is in the exercise or discharge of his powers or duties in a national park established under that Act;

Explanatory Notes 1 This Bill will amend

chapter S-26 of the Revised Statutes of Alberta 1980. 2

Section 1 presently reads: 1 In this Act, 'justice" (

a) means a justice of the peace, and (

b) includes 2 or more justices sitting and acting together a provincial judge, and every other officer or functionary having, for the purpose of any Act, the authority of a justice of the peace or provincial judge. 3

Section 1 (o.

l) presently reads: 1 In this Act (o. 1) 'peace officer" means a member of the Royal Canadian Mounted Police, a member of a municipal police force, a special constable or a member of the patrol division of the Department of the Solicitor Gen eral; Explanatory Notes

4 The Motor Vehicle Administration Act is amended by this section.

(2) Section l(

q) is repealed and the following substituted: (q) "peace officer" means (

i) a member of the Royal Canadian Mounted Police, (ii) a member of a municipal police force, (iii) a special constable, (iv) a patrol officer of the Department of the Solicitor Gen eral, or (

v) a park warden appointed pursuant to the National Parks Act (Canada), while he is in the exercise or discharge of his powers or duties in a national park established under that Act; 5 This Act comes into force on Proclamation.
