Loi sur l’impôt foncier Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1 Subsection 10(5) of the Real Property Tax Act, chap- ter R-2 of the Revised Statutes, 1973, is repealed and the following is substituted: 1 Le paragraphe 10 (5) de la

Loi sur l’impôt foncier,

chapitre R-2 des Lois révisées de 1973, est abrogé et rem- placé par ce qui suit : 10(5) If a person pays an amount that is less than the total amounts he or she owes under this Act, under

section 190.061 of the Municipalities Act and under

section 8.2 of The Residential Tenancies Act, such amount shall be ap- plied as follows: 10(5) Si une personne verse une somme inférieure au total des sommes qu’elle doit payer en vertu de la présente loi, de l’article 190.061 de la

Loi sur les municipalités et de l’article 8.2 de la

Loi sur la location de locaux d’habi- tation, cette somme est imputée de la manière suivante : (

a) first, in payment of the following amounts in the following order:

a) en premier lieu, selon l’ordre suivant : (

i) tax arrears and penalties, other than those per- taining to taxes imposed under paragraphs 5(2)(

a) and (a.1); (

i) au paiement des arriérés d’impôts et des péna- lités, exception faite des arriérés d’impôts et des pé- nalités qui se rapportent aux impôts levés en vertu des alinéas 5(2)

a) et a.1), (ii) the amount of payments referred to in subsec- tion 5(13) and the interest referred to in subsection 5(15) that are due and unpaid; (ii) aux paiements visés au paragraphe 5(13) et à l’intérêt visé au paragraphe 5(15) qui sont dus et im- payés, (iii) the amounts referred to in

section 190.061 of the Municipalities Act that are due to the Minister and unpaid; and (iii) aux paiements visés à l’article 190.061 de la

Loi sur les municipalités qui sont dus au Ministre et impayés, 1 (iv) the residential tenancy administration fee and penalty referred to in

section 8.2 of The Residential Tenancies Act that are due and unpaid; (iv) au paiement du droit d’administration des lo- caux d’habitation et des pénalités visés à l’article 8.2 de la

Loi sur la location de locaux d’habitation qui sont dus et impayés; (

b) second, in payment of tax arrears and penalties that pertain to taxes imposed under paragraphs 5(2)(

a) and (a.1) and collected by the Minister;

b) en deuxième lieu, au paiement des arriérés d’im- pôts et des pénalités qui se rapportent aux impôts levés en vertu des alinéas 5(2)

a) et a.1) et perçus par le Mi- nistre; (

c) third, in payment of the following amounts in the following order:

c) en troisième lieu, selon l’ordre suivant : (

i) taxes, other than taxes imposed under para- graphs 5(2)(

a) and (a.1); and (

a) et a.1), (ii) the residential tenancy administration fee re- ferred to in

d) fourth, in payment of taxes imposed under para- graphs 5(2)(

a) and (a.1) and collected by the Minister.
