Order in Council 434/2023

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas by Order in Council O.C. 434/77, registered in the Land Registry Office for the Land Registry Division of York as Instrument No. MA99853 on September 29, 1977, certain lands were placed under the jurisdiction and control of the former Minister of Government Services, now the Minister of Infrastructure, with a reversionary interest clause in favour of the former Minister of Transportation and Communications, now the Minister of Transportation, requiring the transfer of jurisdiction and control of any part or parts of the lands as may be required from time to time for highway purposes, to the former Minister of Transportation and Communications, now the Minister of Transportation.

And

whereas the parts of the said lands described as follows are not required by the Minister of Transportation for highway purposes:

Part of PIN 03028-0001 (LT) being part of Lots 6 and 21, Registered Plan 2386, Markham, and shown as

Part 2 on Plan 65R‑28842 (P-5052-0278);

All of PIN 03028-0007 (LT) being part of Lots 12 and 13, Registered Plan 2386, Markham, and shown as Parts 6 & 7 on Plan 64R-5269 (P-1658-0248) and Lots 14 and 15 Registered Plan 2386 Markham;

Part of PIN 03028-0014 (LT) being part of Lots 28, 29, 30, 31, 32, 33, 34, 35, 36, 37 & 38, Registered Plan 2386, Markham, and shown as Parts 3 and 4 on Plan 65R-28867(P-5052-0278) and Parts 1, 3, 7 & 8 on Plan 65R‑31668 (P-5052-2790);

Part of PIN 03028-0819 (LT) being part of Lot 7, Registered Plan 2386, Markham, and shown as

Part 3 on Plan 65R‑28842 (P-5052-0278);

Now therefore the land described above is now and hereafter no longer required for the purposes of the Minister of Transportation and it is deemed expedient to release the reversionary interest reserved in Order-in-Council O.C. 434/77, pursuant to subsection 2(2) of the Public Transportation and Highway Improvement Act , R.S.O. 1990,

Chapter P.50 as amended.
