On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Wildlife Act Commercial Activities Regulation, B.C. Reg. 338/82, is amended as set out in the attached Appendix.

Appendix

Section 1.01 of the Wildlife Act Commercial Activities Regulation, B.C. Reg. 338/82, is amended

(

a) by striking out “ shall carry, ” and substituting “ must carry, ”,

(

b) in paragraph (

b) by striking out “ an annual licence, ” and substituting “ a guide outfitter licence, ”, and

(

c) by repealing paragraph (

c) and substituting the following:

(

c) effective for the term the guide outfitter licence is valid.

Section 1.10, excluding

Schedule 1.10, is repealed and the following substituted:

Guide outfitter licence fees

1.10

(1) The guide outfitter licence fee payable for a guide outfitter licence issued for a term

(

a) up to and including 12 months is set out in

Schedule 1.10 (1), and

(

b) greater than 12 months is set out in

Schedule 1.10 (1.1).

(2) The guide outfitter licence fee described in subsection (1) must be paid on or before the first day of the term of the guide outfitter licence.

(3) A duplicate copy of a guide outfitter licence or assistant guide licence may be issued by an employee of the ministry authorized to issue guide outfitter or assistant guide licences if the licence holder

(

a) signs a declaration affirming that the licence has been lost, stolen or destroyed, and

(

b) pays the fees set out in

(

i) Schedule 1.10 (6) or (7), as applicable, for the duplicate licence, and

(ii)

Schedule 1.10 (8) for the declaration.

Schedule 1.10 is amended

(

a) in Item (1) by striking out “ guide outfitter licence ” and substituting “ guide outfitter licence – term up to and including 12 months ”,

(

b) by adding the following Item as indicated:

(

c) in Item (3) by striking out “ late payment fee ” and substituting “ licence application fee ”.

4 Sections 1.11, 1.12 and 1.14 are repealed and the following substituted:

Offences

1.11 An applicant for a guide outfitter licence commits an offence if the applicant

(

a) fails to pay

(

i) the guide outfitter licence fee in accordance with

section 1.10 (2),

(ii) the surcharge in accordance with

section 1.14 (2), or

(iii) both the fee and surcharge referred to in subparagraphs (

i) and (ii), and

(

b) guides, or employs an assistant guide to guide on the applicant’s behalf.

Fees

1.12

(1) An applicant for a guide outfitter licence who has not previously held a guide outfitter licence must, at the time the applicant submits the application to the regional manager, pay the fee set out in

Schedule 1.10 (3).

(2) If the rights to a guide territory are transferred to a guide outfitter, the guide outfitter must pay the fee set out in

Schedule 1.10 (4).

(3) For the purpose of

section 65 (3) of the Wildlife Act , if the rights to a fractional guide area are assigned to a guide outfitter, the guide outfitter must pay the fee set out in

Schedule 1.10 (5).

Surcharge

1.14

(1) The surcharge payable for a guide outfitter licence issued for a term

(

a) up to and including 12 months is set out in

Schedule 1.10 (1), and

(

b) greater than 12 months is set out in

Schedule 1.10 (1.1).

(2) The surcharge described in subsection (1) must be paid on or before the first day of the term of the guide outfitter licence.
