Government Organization Act
ALBERTA VOCATIONAL COLLEGES AMENDMENT REGULATION
Filed: July 18, 1995
Made by the Minister of Advanced Education and Career Development pursuant
to
Schedule 1 of the Government Organization Act.
1 The Alberta Vocational Colleges Regulation (Alta. Reg. 194/90) is
amended by this Regulation.
Section 1(
a) is repealed and the following is substituted:
(a) "Act" means the Government Organization Act;
Schedule 1 is amended
(
a) in
section 1 by repealing subsections (1) and (2) and
substituting the following:
1(1) Tuition fees for credit programs shall be established by
the president in accordance with the Alberta Vocational College Tuition Fee
Policy.
(1.1) Notwithstanding subsection (1), tuition fees for credit
programs for the 1995-96 academic year are as follows:
(
a) for a credit program that is one trimester in
length, $200;
(
b) for a credit program that is one semester in
length, $290.
(1.2) The tuition fee for a credit program for a student who
is not a Canadian citizen or permanent resident of Canada is double the
tuition fee established for that credit program for Canadian citizens and
permanent residents of Canada.
(2) The tuition fee for a student enrolled in a credit program
or course on a part-time basis is the tuition fee set by the president,
which must be a portion of the full-time fee established for that program.
(
b) by repealing sections 9 and 10.
4 This Regulation comes into force on August 1, 1995.

Local Authorities Election Act
FORMS AMENDMENT REGULATION
Filed: July 18, 1995
Made by the Minister of Municipal Affairs (M.O. L:349/95) pursuant to
section 160(2) of the Local Authorities Election Act.
This regulation takes effect on July 21, 1995.
1 The Forms Regulation (Alta. Reg. 272/91) is amended by this Regulation.
2 The part of the
Schedule preceding the forms is amended in the line for
Form 6 under the column headed "In Respect of Section" by striking out ",
44".
3 Forms 2SV, 5, 6, 7, 8, 8SV and 10 of the
Schedule are repealed and the
forms at the end of this Regulation are substituted.
4 For the purposes of an election in 1995, a summer village may use
either the forms repealed by
section 3, except for Form 8, or the forms
substituted by
section 3, except for Form 8.

Marketing of Agricultural Products Act
EGG PRODUCTION AND MARKETING
AMENDMENT REGULATION

Made by the Alberta Egg Producers Board pursuant to
section 27 of the
Marketing of Agricultural Products Act.
1 The Egg Production and Marketing Regulation (Alta. Reg. 28/93) is
amended by this Regulation.
Section 20.1 is repealed and the following is substituted:
Quota re-location between commonly owned production facilities
20.1 Where
(
a) a production facility is being used to produce the
regulated product pursuant to a quota,
(
b) another production facility is owned
(
i) by the holder of the quota,
(ii) by the shareholders of a corporation
that is the holder of the quota, or
(iii) by the partners of a partnership that
is the holder of the quota,
(
c) the quota holder wishes to relocate all or part of
that quota to that other production facility, and
(
d) the production facility from which the quota holder
wishes to relocate the quota has been in continuous production of the
regulated product for not less than 3 years immediately preceding the day
on which the quota holder applies to the Board to relocate the quota,
the Board may relocate all or part of that quota to that other
production facility.

Public Sector Pension Plans Act
UNIVERSITIES ACADEMIC PENSION PLAN (CONTRIBUTION
RATES) AMENDMENT REGULATION, 1995

Made by the Universities Academic Pension Board pursuant to sections 5(2)
and 9(6) of
Schedule 3 of the Public Sector Pension Plans Act.
1 The Universities Academic Pension Plan (Alta. Reg. 370/93) is amended
by this Regulation.
Section 13 is amended
(
a) in subsection (1) by striking out "percentage rate of his
pensionable salary set for employees by the Board's plan rules under
section 5(2) of the Act Schedule" and substituting the following:
rate, based on pensionable salary or any portion of the
participant's pensionable salary
(
a) that does not exceed the year's maximum
pensionable earnings, of 5.4%, and
(
b) that does exceed those earnings, of
7.9%,
or, if applicable, at the rate specified in subsection
(1.1).
(
b) by adding the following after subsection (1):
(1.1) Notwithstanding subsection (1), the rate of
contributions payable by participants employed by the University of
Calgary, the University of Alberta and the University of Lethbridge for
current service for which participants are receiving remuneration, based on
pensionable salary or any portion of the participant's pensionable salary
(
a) that does not exceed the year's maximum
pensionable earnings, is 5.9%, and
(
b) that does exceed those earnings, is
8.4%.
Section 15 is amended
(
a) in subsection (1) by striking out "percentage rate of the
participant's pensionable salary set for employers by the Board's plan
rules under
section 5(2) of the Act Schedule" and substituting the
following:
rate, based on pensionable salary or any portion of the
participant's pensionable salary
(
a) that does not exceed the year's maximum
pensionable earnings, of 6.4%, and
(
b) that does exceed those earnings, of
8.9%,
or, if applicable, at the rate specified in subsection
(1.1).
(
b) by adding the following after subsection (1):
(1.1) Notwithstanding subsection (1), the rate of
contributions payable by the University of Calgary, the University of
Alberta and the University of Lethbridge for current service for which
participants are receiving remuneration, based on pensionable salary or any
portion of a participant's pensionable salary
(
a) that does not exceed the year's maximum
pensionable earnings, is 5.9%, and
(
b) that does exceed those earnings, is
8.4%.
Section 16 is amended
(
a) by renumbering it as
section 16(1);
(
b) in subsection (1) by adding "and by this section" after
"Schedule";
(
c) by adding the following after subsection (1):
(1.1) The aggregate amount of the annual additional
contributions required from employers and participants in the years before
the next actuarial valuation after the commencement of this subsection in
order to ensure the elimination of the unfunded liability on or before
December 31, 2043, after taking into account the annual amount of
additional contributions payable by the Crown under
section 9(5)(
a) of the
Act Schedule, is that resulting from the charging of the additional
contribution rates set by subsection (2).
(2) The rate of additional contributions payable both by
participants and by employers to meet their respective liability for 50% of
the total required, within the meaning of
section 9(7) of the Act Schedule,
(
a) from August 1, 1995 to July 31, 1996, is 1%, and
(
b) from August 1, 1996, is 1.375%
of salary.
Section 113 is repealed.
6 This Regulation comes into force on August 1, 1995.

Hospitals Act
OPERATION OF APPROVED HOSPITALS AMENDMENT REGULATION
Filed: July 26, 1995
Made by the Lieutenant Governor in Council (O.C. 520/95) pursuant to
section 44 of the Hospitals Act.
1 The Operation of Approved Hospitals Regulation (Alta. Reg. 247/90) is
amended by this Regulation.
Section 1(1) is amended by adding the following after clause (a):
(b) "graduate nurse" means a person who has graduated from a
recognized formal educational program and is eligible but is not registered
pursuant to the Nursing Profession Act;
Section 22(1) is amended by striking out "have training" and
substituting "be a graduate nurse with special training".
Section 27 is amended by adding the following after subsection (3):
(4) Adequate graduate nurse coverage shall be provided at all times
in the hospital.

Real Estate Agents' Licensing Act
QUALIFICATIONS AND FEES AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 524/95) pursuant to
section 56 of the Real Estate Agents' Licensing Act.
1 The Qualifications and Fees Regulation (Alta. Reg. 393/84) is amended
by this Regulation.
Section 4.1(2) is repealed and the following is substituted:
(2) The Provincial Treasurer shall, within 7 business days after
receiving fees referred to in subsection (1) remit to the Association an
amount equal to 99% of the fees so received and, subject to subsection
(2.1) the Association shall use the fees only for the purpose of performing
the obligations and functions and exercising the rights delegated to it.
(2.1) The Association shall keep 19% of the fees it receives under
subsection (2) in an account separate from the other fees it receives under
subsection (2) and shall use that 19% only for purposes related to the
establishment of the Council under the Real Estate Act.
