EXPLANATORY NOTES

This Bill would amend the Forestry Act to delete references to the

fiscal year. Instead, references would

be to a calendar year.

Clause 1 of this Bill would delete a

reference to "April 1" and substitute instead a reference to

"January 1".

Clause 2 of the Bill would amend a

subsection of the Act relating to the ability to make retroactive regulations

setting timber royalty rates. Currently,

those rates can be made retroactively based on a fiscal year. The proposed change would allow the rates to

be made retroactively on a calendar year basis.

Clause 3 of the Bill is a

commencement clause. It would make the

changes contained in the Bill retroactive to January 1 of this year so the

proposed change can be effective for 2008.

3. Commencement

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

amended

1. Subsection 29(4) of the Forestry Act is amended by deleting the date "April 1"

and substituting the date "January 1".

2. Subsection 35(2) of the Act is repealed and the

following substituted:

(2) Regulations made under subsection

(1) respecting stumpage rates or other royalties or charges may be made with

retroactive effect to January 1 of the year in which the stumpage rates or

other royalties or charges are payable.

Commencement

3. This Act shall be considered to have come into

force on January

1, 2008 .
