EXPLANATORY NOTE The Bill requires the Minister to establish a commission to draft the necessary legislation to implement a restructuring proposal for The Regional Municipality of Hamilton-Wentworth dated February 23, 1997 that the councils of the regional municipality and the area municipalities have approved. Under the restructuring the regional municipality would be dissolved on January 1, 2001. The commission is required to submit the draft to the Minister within one year of the establishment of the commission.

The Min- ister is required to introduce legislation on or before November 1, 2000 to implement the restructuring. NOTE EXPLICATIVE Le projet de loi exige que le ministre crée une commission qui est chargée de rédiger le projet de loi nécessaire à la mise en œuvre de la proposition de restructuration de la municipalité régionale de Hamilton-Wentworth en date du 23 février 1997 que les conseils de la municipalité régionale et des municipalités de secteur ont approu- vée. Aux termes de la restructuration, la municipalité régionale sera dissoute le 1 er janvier 2001.

La commission est tenue de présenter son ébauche au ministre dans l’année qui suit la création de la commission. Le ministre est tenu de déposer un projet de loi au plus tard le 1 er novembre 2000 afin de mettre en œuvre la restructuration.

An Act to amend the Municipal Act to provide for the restructuring of municipal government in the Greater Hamilton Area The inhabitants of the Towns of Ancaster, Dundas and Flamborough, the Township of Glanbrook and the City of Stoney Creek, in a referendum held on February 8, 1997, voted decisively in favour of retaining the council of their area municipalities. The councils of The Regional Municipality of Hamilton-Wentworth and its area municipal- ities have approved a restructuring proposal dated February 23, 1997 that provides for the dissolution of the regional municipality.

No other proposal has received the support of the majority of the councils of the area municipalities or the approval of the inhabit- ants of the area municipalities in a referen- dum. It is desirable to have legislation prepared to implement the restructuring proposal that the councils of the area municipalities have approved. Therefore, Her Majesty, by and with the advice and consent of the Legislative Assem- bly of the Province of Ontario, enacts as follows: 1. The Municipal Act is amended by adding the following section: 25.5

(1) Within 30 days following the day on which this

section comes into force, the Minister shall establish a commission to pre- pare the restructuring plan described in sub- section (2) for The Regional Municipality of Hamilton-Wentworth and its area municipal- ities and to draft the necessary legislation to implement the plan.

(2) The restructuring plan shall provide that, (

a) the regional municipality is dissolved on January 1, 2001; (

Les conseils de la municipalité régionale de Hamilton-Wentworth et de ses municipalités de secteur ont approuvé une proposition de restructuration en date du 23 février 1997 qui prévoit la dissolution de la municipalité régio- nale.

Aucune autre proposition n’a reçu le soutien de la majorité des conseils des municipalités de secteur ou l’approbation des habitants des municipalités de secteur dans un référendum. Il est souhaitable de rédiger le projet de loi nécessaire à la mise en œuvre de la proposi- tion de restructuration que les conseils de mu- nicipalités de secteur ont approuvée. Pour ces motifs, Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative de la province de l’Ontario, édicte : 1. La

(1) Dans les 30 jours qui suivent le jour de l’entrée en vigueur du présent article, le ministre crée une commission qui est char- gée d’élaborer le plan de restructuration visé au paragraphe (2) pour la municipalité régio- nale de Hamilton-Wentworth et ses municipa- lités de secteur et de rédiger le projet de loi nécessaire à la mise en œuvre du plan.

(2) Le plan de restructuration prévoit que :

a) la municipalité régionale est dissoute le 1 er janvier 2001;

c) despite

d) despite

section 29, each of the members of the council of the City of Hamilton who is not the head of the council shall be elected on the basis of one per ward; (

e) the part of the finances of each of the area municipalities that is specified in the proposal described in clause (

b) be pooled among the area municipalities in the manner specified by the proposal; and (

f) the other matters contained in the pro- posal described in clause (

b) shall be dealt with.

(3) The restructuring plan shall not provide for a type of restructuring that is inconsistent with the proposal described in clause (2) (b).

(4) The commission shall prepare the restructuring plan, draft the necessary legisla- tion to implement it and submit the draft to the Minister within one year of the establish- ment of the commission.

(5) On or before November 1, 2000, the Minister shall introduce the necessary legisla- tion to implement the restructuring plan.

(6) The Minister may, for the purposes of this section, make regulations, (

a) establishing the commission; (

b) providing for the composition of the commission, which may be composed of one person; and

(4) La commission élabore le plan de re- structuration, rédige le projet de loi nécessaire à la mise en œuvre du plan et présente son ébauche au ministre dans l’année qui suit la création de la commission.

(5) Le ministre est tenu de déposer le projet de loi nécessaire à la mise en œuvre du plan de restructuration au plus tard le 1 er novembre 2000.

(6) Pour l’application du présent article, le ministre peut, par règlement :

a) créer la commission;

(7) Costs that the commission apportions to a municipality are a debt of the municipality to the Crown. 2. This Act comes into force on the day it receives Royal Assent. 3. The

short title of this Act is the Greater Hamilton Area Municipal Restructuring Act, 1998.
