An Act to Amend the Income Tax Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1 The Income Tax Act,

chapter I-2 of the Revised Statutes, 1973, is amended by adding after

section 2.5 the following: 2.6(1) For the purposes of this

section “individual” means a natural person and, not- withstanding subsection 56(1), does not include a trust or estate; “smoking-cessation product” means any smoking-cessation product approved by Health Ca- nada; “tax otherwise payable” means the amount of provincial tax payable under this Act, after the in- clusion of any provincial tax credits, by the individ- ual before the application of this section. 2.6(2) There may be deducted from the tax other- wise payable under this Act by an individual for a taxation year an amount determined by the formula (A⁄B) × C PROJET DE LOI Loi modifiant la Loi de l’impôt sur le revenu Sa Majesté, sur l’avis et du consentement de l’Assemblée législative du Nouveau-Brunswick, décrète : 1 La Loi de l’impôt sur le revenu,

chapitre I-2 des Lois révisées de 1973 , est modifiée par l’ad- jonction, après l’article 2.5, de ce qui suit : 2.6(1) Pour les fins de la présente loi « impôt payable par ailleurs » désigne le montant de taxe provinciale en vertu de la présente loi qui se- rait, suite à l’inclusion des crédits d’impôt, l’impôt payable avant l’application de cet article; « particulier » une personne physique mais, par dérogation au paragraphe 56(1), ne s’entend pas d’une fiducie ou d’une succession; « produit de désaccoutumance au tabac » tout produit de désaccoutumance au tabac approuvé par Santé Canada. 2.6(2) Il peut être déduit de l’impôt payable par ailleurs en vertu de la présente loi pour l’année d’imposition un montant déterminé par la formule (A⁄B) × C Projet de loi Loi modifiant la Loi de l’impôt sur le revenu where A is the amount of tax otherwise payable; B is the individual’s taxable income; and C is the lesser of (
