An Act to Amend

An Act Respecting Building Officials and the New Brunswick Building Officials Association WHEREAS the New Brunswick Building Officials As- sociation prays that it be enacted as hereinafter set forth; THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Bruns- wick, enacts as follows: 1 Subsection 2(1) of

An Act Respecting Building Offi- cials and the New Brunswick Building Officials Associ- ation,

chapter of the Acts of New Brunswick, 2002, is amended (

a) by repealing the definition “CBCO”; (

b) by adding the following definition in alphabeti- cal order: “NBCBO” means New Brunswick Certified Building Official, as identified in the bylaws of the New Brunswick Building Officials Association; 2 Subsection 2(2) of the Act is repealed and the follow- ing is substituted: 2(2) The words “Building Official”, “New Brunswick Certified Building Official”, “Building Code Qualified Official” and the initials “NBCBO” or “BCQO” used alone or in any other combination with other words or ex- pressions when used in any provision of

chapitre des Lois du Nouveau-Brunswick de 2002, est modifié

a) par l’abrogation de la définition « OCCB »;

b) par d’adjonction de la définition qui suit selon son ordre alphabetique : « OCCBNB » désigne un officiel certifié relativement au code du bâtiment du Nouveau-Brunswick, défini dans les règlements administratifs de l’Association des offi- ciels de la construction du Nouveau-Brunswick; 2 Le paragraphe 2(2) de la Loi est abrogé et remplacé par ce qui suit : 2(2) Les mots « officiels de la construction », « officiel certifié relativement au code du bâtiment du Nouveau- Brunswick », « officiel qualifié pour appliquer le code du bâtiment » et les initiales « OCCBNB » ou « OQCB » uti- lisés seuls ou avec d’autres mots ou expressions dans une Projet de loi Loi modifiant la Loi concernant les officiels de la construction et l’Association des officiels de la construction du Nouveau-Brunswick Legislature or any regulation, rule, order or bylaws made under

an Act of the Legislature enacted or made before, at or after the commencement of the Act or when used in any public document, shall be read as including a person whose name is entered in the register. 3

Section of the Act is repealed and the following is substituted: 11 Any person whose name is entered in the register, subject to any conditions, limitations or restrictions set out in the bylaws shall be entitled to engage in the occupation of building inspection in the province, to hold themselves out as a Building Official registered under this Act and to use the designations “NBCBO” or “BCQO” indicating that the person is a Member entered on the register of the Association. 4

Section of the Act is repealed and the following is substituted: 18 Except as provided in the Act or the bylaws, no per- son other than a person whose name is entered in the reg- ister shall (

a) publicly or privately, whether or not for hire, gain or hope of reward, hold himself or herself out in any way as being a Building Official, or (

a) publiquement ou en privé, que ce soit pour le compte d’autrui ou non, obtenir ou espérer obtenir une récompense pour elle-même en tant qu’officiel de la construction, ou

b) prendre ou utiliser un titre, un nom, une désigna- tion, des initiales ou une description, y compris « officiel de la construction », « officiel certifié relati- vement au code du bâtiment du Nouveau-Brunswick », « officiel qualifié pour appliquer le code du bâtiment », « OCCBNB », « OQCB », et les titres et les désigna- tions mentionnées dans la présente Loi qui portent le public à croire que la personne est un officiel de la construction.
