Loi sur les mines Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1 The Mining Act,

chapter M-14.1 of the Acts of New Brunswick, 1985, is amended by adding the following after

section 1.2: 1 La

chapitre M-14.1 des Lois du Nouveau-Brunswick de 1985, est modifiée par l’ad- jonction de ce qui suit après l’article 1.2 : Meaning of actual damage to or interference with the use and enjoyment of private land Sens de « dommages réels à une terre privée ou entrave à la jouissance de celle-ci » 1.3 A prospector or a person acting on behalf of the prospector who walks on private land, or collects sam- ples on private land by hand or by the use of a handheld tool, including a rock hammer or handheld auger, not ex- ceeding kg or l each for the purpose of mineralogical identification or analysis, is deemed not to cause actual damage to or interference with the use and enjoyment of the land within the meaning of this Act. 1.3 Est réputé ne causer aucun dommage réel à une terre privée ni aucune entrave à la jouissance de celle-ci au sens de la présente loi le prospecteur ou son représen- tant qui y marche ou y prélève des échantillons de moins de kg ou L chacun, à la main ou à l’aide d’un outil à main, notamment un marteau brise-roche ou une tarière manuelle, à des fins d’identification ou d’analyse miné- ralogique. 2

Section 48.4 of the Act is amended L’article 48.4 de la Loi est modifié (

a) in subsection (1) in the portion preceding the definition “ground staked mineral claim” by striking out “sections 48.5 to 48.8” and substituting “sections 48.5, 48.6 and 48.9”;

a) au paragraphe (1), au passage qui précède la définition de « claim jalonné au sol », par la sup- pression de « articles 48.5 à 48.8 » et son remplace- ment par « articles 48.5, 48.6 et 48.9 »; (

b) by repealing subsection (3);

d) by repealing subsection (5);

section the following: 7 La Loi est modifiée par l’adjonction de ce qui suit avant l’article 50 : Identification of the boundaries of ground staked mineral claims over the same mineral claim unit Détermination des limites d’un claim jalonné au sol existant dans la même unité de claims 48.9 If a mineral claim unit covers portions of more than one ground staked mineral claim, the boundaries of the ground staked mineral claims shall be identified in the same manner as under subsection 48.4(6). 48.9 Si une unité de claims comporte des portions de plus d’un claim jalonné au sol, les limites des claims ja- lonnés au sol sont déterminées selon ce que prévoit le paragraphe 48.4(6).
