APPENDIX
Order respecting Medical Assistance in Dying Standards of Practice
The Lieutenant Governor in Council, on the recommendation of the Minister of
Health, amends the standards of practice entitled "Medical Assistance in Dying",
adopted by the council of the College of Physicians and Surgeons of Alberta on May
27, 2016 by adding the following after section (2):
(2.1)Before a regulated member provides a patient with medical assistance in
dying, the regulated member must
(
a) be of the opinion that the patient
i. is eligible, or but for any applicable minimum period of residence
or waiting period, would be eligible for health services funded by a
federal, provincial or territorial government in Canada,
ii. is at least 18 years of age,
iii. is capable of making decisions with respect to their health,
iv. has a grievous and irremediable medical condition that causes
enduring suffering that is intolerable to the patient in the
circumstances of their condition and that cannot be relieved under
conditions that the patient considers acceptable,
v. has made a voluntary request for medical assistance in dying that,
in particular, was not made as a result of external pressure, and
vi. gives informed consent to receive medical assistance in dying,
(
b) ensure that the patient's request for medical assistance in dying was
made in writing and was signed and dated by the patient or by another
person on their behalf under section (2.2),
(
c) be satisfied that the request was signed and dated by the patient or by
another person on the patient's behalf before two independent witnesses
who then also signed and dated the request,
(
d) ensure that the patient has been informed that they may, at any time and
in any manner, withdraw their request,
(
e) ensure that another regulated member, or an individual who has a
similar status under similar legislation in another Canadian jurisdiction,
has provided a written opinion confirming that the patient meets all of
the criteria set out in clause (a),
(
f) be satisfied that they and the other individual referred to in clause (
e) are independent,
(
g) immediately before providing the medical assistance in dying, give the
patient an opportunity to withdraw their request and ensure that the
patient gives express consent to receive medical assistance in dying,
and
(
h) if the patient has difficulty communicating, take all necessary measures
to provide a reliable means by which the patient may understand the
information that is provided to them and communicate their decision.
(2.2)If the patient requesting medical assistance in dying is unable to sign and
date the request, another person who is at least 18 years of age and who
understands the nature of the request for medical assistance in dying may
sign and date the request in the patient's presence, on the patient's behalf
and under the patient's express direction.
(2.3)Any person who is at least 18 years of age and who understands the nature
of the request for medical assistance in dying may act as an independent
witness, except if they
(
a) know or believe that they are a beneficiary under the will of the patient
making the request, or a recipient, in any other way, of a financial or
other material benefit resulting from the patient's death,
(
b) are an owner or operator of any health care facility at which the patient
making the request is being treated or any facility in which the patient
resides,
(
c) are directly involved in providing health care services to the patient
making the request, or
(
d) directly provide personal care to the patient making the request.
(2.4)The regulated member providing medical assistance in dying and the
regulated member or other individual who provides the opinion referred to
in
section ( 2.1)(
e) are independent if they
(
a) are not a mentor to the other regulated member or individual, or
responsible for supervising the other's work,
(
b) do not know or believe that they are a beneficiary under the will of the
patient making the request, or a recipient, in any other way, of a
financial or other material benefit resulting from the patient's death,
other than standard compensation for their services relating to the
request, or
(
c) do not know or believe that they are connected to the other regulated
member or individual, or to the patient making the request, in any other
way that would affect their objectivity.
(2.5)Medical assistance in dying must be provided with reasonable knowledge,
care and skill and in accordance with any applicable enactment, rules or
standards.
(2.6)The regulated member who, in providing medical assistance in dying,
prescribes or obtains a drug for that purpose must, before any pharmacist
dispenses the drug, inform the pharmacist that the drug is intended for that
purpose.
(3) A regulated member who receives an inquiry from a patient with respect to
medical assistance in dying must ensure that contact information for the
Alberta Health Services medical assistance in dying care coordination
service is provided to the patient, or to another person identified by the
patient, without delay.
(4) A regulated member who receives an oral or written request from a patient
for medical assistance in dying and who declines for reasons of conscience
or religion to provide or to aid in providing medical assistance in dying must
ensure that reasonable access to the Alberta Health Services medical
assistance in dying care coordination service is provided to the patient
without delay.
(5) A regulated member may prescribe a drug for use in medical assistance in
dying only if the drug has been recommended for the use by the Alberta
Health Services medical assistance in dying care coordination service.
(6) A regulated member who provides medical assistance in dying must keep
records in the form and manner required by the Minister confirming that the
requirements of these standards, and any other standards or legislation
applicable to medical assistance in dying, were met.
(7) A regulated member who provides medical assistance in dying must,
without delay, provide a member of the Medical Assistance in Dying
Regulatory Review Committee designated by the Committee with copies of
the records referred to in section (6).
(8) In these standards, "medical assistance in dying" means
(
a) the administering by a regulated member of a substance to a person, at
their request, that causes their death; or
(
b) the prescribing or providing by a regulated member of a substance to a
person, at their request, so that they may self-administer the substance
and in doing so cause their own death.

APPENDIX
Medical Assistance in Dying Standards of Practice for Nurse Practitioners
College and Association of Registered Nurses of Alberta
Interpretation - medical assistance in dying
1. In these standards,
(a) "medical assistance in dying" means
(
i) the administering by a nurse practitioner of a substance to a patient, at the
patient's request, that causes the patient's death; or
(ii) the prescribing or providing by a nurse practitioner of a substance to a
patient, at the patient's request, so that the patient may self-administer the
substance and in doing so cause his or her own death;
(b) "nurse practitioner" means a regulated member who is registered on the nurse
practitioner register under the Registered Nurses Profession Regulation (AR
232/2005).
Compliance with legislation
2. A nurse practitioner who receives, considers or fulfils a written request for
medical assistance in dying must do so in accordance with legislation.
Requirement on inquiry from patient
3. A nurse practitioner who receives an inquiry from a patient with respect to
medical assistance in dying must communicate promptly and respectfully with
the patient and must ensure that contact information for the Alberta Health
Services Medical Assistance in Dying Care Coordination Service is provided to
the patient, or to another person identified by the patient, without delay.
Requirement on request from patient
4. A nurse practitioner who receives an oral or written request from a patient for
medical assistance in dying and who declines for reasons of conscience or
religion to provide or to aid in providing medical assistance in dying must ensure
that reasonable access to the Alberta Health Services Medical Assistance in
Dying Care Coordination Service is provided to the patient without delay.
Informed consent
5. A nurse practitioner who obtains informed consent for the purpose of medical
assistance in dying from a patient who has requested the assistance, must ensure
that the patient
(
a) is aware of his or her right to withdraw consent at any time,
(
b) is free of undue influence, duress or coercion in making the consent decision,
(
c) is informed of
(
i) the diagnosis reached,
(ii) the advised interventions and treatments for his or her condition, the
exact nature and anticipated benefits of the advised interventions and
treatments and their associated common risks and significant risks,
(iii) the reasonable alternative treatments available for his or her condition,
the exact nature and anticipated benefits of the reasonable alternative
treatments and their associated common risks and significant risks,
(iv) the exact nature of the medical assistance in dying procedure and its
associated common risks and significant risks, and
(
v) the natural history of his or her condition and the consequences both of
receiving and of not receiving medical assistance in dying,
and
(
d) demonstrates a reasonable understanding of the information provided and the
reasonably foreseeable consequences both of receiving and of not receiving
medical assistance in dying.
Requirements for plan, collaboration and notification
6. A nurse practitioner who provides medical assistance in dying must
(
a) discuss and agree on a plan with the patient that considers
(
i) the patient's wishes regarding when, where and how the medical
assistance in dying will be provided, including the presence of the nurse
practitioner and any additional support,
(ii) an alternate plan to address potential complications, and
(iii) the patient's choice to rescind the request at any time, including
immediately before the provision of medical assistance in dying,
(
b) collaborate with the pharmacist dispensing the drug(s), and
(
c) after the patient's death, notify the Office of the Chief Medical Examiner.
Restriction on drugs that may be used
7. A nurse practitioner may prescribe a drug for use in medical assistance in dying
only if the drug has been recommended for the use by the Alberta Health
Services Medical Assistance in Dying Care Coordination Service.
Records
8. A nurse practitioner who provides medical assistance in dying must keep records
in the form and manner required by the Minister confirming that the
requirements of these standards, and any other standards or legislation applicable
to medical assistance in dying, were met.
Medical Assistance in Dying Regulatory Review Committee
9. A nurse practitioner who provides medical assistance in dying must, without
delay, provide a member of the Medical Assistance in Dying Regulatory Review
Committee designated by the Committee with copies of the records referred to in
section 8.

Made as a rule by the Alberta Securities Commission on December 14, 2016 pursuant
to sections 223 and 224 of the Securities Act.
AMENDMENTS TO
NATIONAL INSTRUMENT 58-101 DISCLOSURE OF CORPORATE
GOVERNANCE PRACTICES
1. National Instrument 58-101 Disclosure of Corporate Governance Practices is
amended by this Instrument.
Section 1.1 is amended by adding the following definition:
"major subsidiary" has the same meaning as in National Instrument 55-104
Insider Reporting Requirements and Exemptions; .
3. Form 58-101F1 Corporate Governance Disclosure is amended by adding the
following items:
10. Director Term Limits and Other Mechanisms of Board Renewal -
Disclose whether or not the issuer has adopted term limits for the
directors on its board or other mechanisms of board renewal and, if so,
include a description of those director term limits or other mechanisms
of board renewal. If the issuer has not adopted director term limits or
other mechanisms of board renewal, disclose why it has not done so.
11. Policies Regarding the Representation of Women on the Board -
(
a) Disclose whether the issuer has adopted a written policy relating
to the identification and nomination of women directors. If the
issuer has not adopted such a policy, disclose why it has not done
so.
(
b) If an issuer has adopted a policy referred to in (a), disclose the
following in respect of the policy:
(
i) a short
summary of its objectives and key provisions,
(ii) the measures taken to ensure that the policy has been
effectively implemented,
(iii) annual and cumulative progress by the issuer in achieving
the objectives of the policy, and
(iv) whether and, if so, how the board or its nominating
committee measures the effectiveness of the policy.
12. Consideration of the Representation of Women in the Director
Identification and Selection Process -
Disclose whether and, if so, how the board or nominating committee
considers the level of representation of women on the board in
identifying and nominating candidates for election or re-election to the
board. If the issuer does not consider the level of representation of
women on the board in identifying and nominating candidates for
election or re-election to the board, disclose the issuer's reasons for not
doing so.
13. Consideration Given to the Representation of Women in Executive
Officer Appointments -
Disclose whether and, if so, how the issuer considers the level of
representation of women in executive officer positions when making
executive officer appointments. If the issuer does not consider the level
of representation of women in executive officer positions when making
executive officer appointments, disclose the issuer's reasons for not
doing so.
14. Issuer's Targets Regarding the Representation of Women on the
Board and in Executive Officer Positions -
(
a) For purposes of this Item, a "target" means a number or
percentage, or a range of numbers or percentages, adopted by the
issuer of women on the issuer's board or in executive officer
positions of the issuer by a specific date.
(
b) Disclose whether the issuer has adopted a target regarding women
on the issuer's board. If the issuer has not adopted a target,
disclose why it has not done so.
(
c) Disclose whether the issuer has adopted a target regarding women
in executive officer positions of the issuer. If the issuer has not
adopted a target, disclose why it has not done so.
(
d) If the issuer has adopted a target referred to in either (
b) or (c),
disclose:
(
i) the target, and
(ii) the annual and cumulative progress of the issuer in
achieving the target.
15. Number of Women on the Board and in Executive Officer
Positions -
(
a) Disclose the number and proportion (in percentage terms) of
directors on the issuer's board who are women.
(
b) Disclose the number and proportion (in percentage terms) of
executive officers of the issuer, including all major subsidiaries of
the issuer, who are women. .
4. The Instructions of Form 58-101F1 are amended by adding the following
sections:
(4) An issuer may disclose any additional information that is relevant in
order to understand the context of the information disclosed by the
issuer under Item 15(
a) or (
b) of this Form.
(5) An issuer may incorporate information required to be disclosed under
Items 10 to 15 by reference to another document. The issuer must clearly
identify the reference document or any excerpt of it that the issuer
incorporates into the disclosure provided under Items 10 to 15. Unless
the issuer has already filed the reference document or excerpt under its
SEDAR profile, the issuer must file it at the same time as it files the
document containing the disclosure required under this Form. .
5. This Instrument only applies to management information circulars and AIFs, as
the case may be, which are filed following an issuer's financial year ending on
or after December 31, 2016.
6. This Instrument comes into force on December 31, 2016.
