EXPLANATORY

NOTE

The

Bill amends the Public Transportation and Highway

Improvement Act by adding a new

section 29.0.1, which provides that

Ottawa Road 174 and County Road 17 cease to be vested in any municipality and

are instead under the jurisdiction and control of the Ministry of

Transportation. Subsection 29.0.1 (1) further provides that the highways are no

longer deemed to be part of the road system of any municipality and that any

agreements or permits granted by a municipality in relation to the highways

continue in force as though made or granted by the Minister. Subsection 29.0.1

(2) limits the ability of the Lieutenant Governor in Council to direct any

further transfers in respect of the highways.

Act to amend the Public Transportation and Highway Improvement Act with respect

to the jurisdiction and control of Ottawa Road 174 and County Road 17

His

Majesty, by and with the advice and consent of the Legislative Assembly of the

Province of Ontario, enacts as follows:

The Public Transportation and Highway Improvement Act

is amended by adding the following section:

Road 174 and County Road 17

29.0.1

(1) Despite

any direction made by the Lieutenant Governor in Council under

section 29, the

highways known as Ottawa Road 174 and County Road 17 cease to be vested in any

municipality and are instead under the jurisdiction and control of the Ministry

and,

(

a) the

highways are no longer deemed to be part of the road system of any

municipality;

(

b) any

agreements made or permits granted by a municipality in relation to the

highways shall continue in force as though made or granted by the Minister; and

(

c) all

rights, privileges and benefits conferred upon or retained by a municipality in

any agreement referred to in clause (

b) shall enure to the benefit of and be

binding upon the Crown in right of Ontario .

(2) The

Lieutenant Governor in Council may not direct a transfer under subsection 29

(4) of the highways referred to in subsection (1).

Commencement

This Act comes into force on the day it receives Royal Assent.

title

The

short title of this Act is the Uploading Highways 174 and 17 Act, 2023 .
