Section 12 of the Condominium Property Act, chap- ter 16.05 of the Acts of New Brunswick, 2009, is amended 1 L’article 12 de la

chapitre 16.05 des Lois du Nouveau-Brunswick de 2009, est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 12(1) The registration of a phased-development condo- minium property constitutes a subdivision of land and cre- ates a lot as described in the description of that phase of the development. 12(1) L’enregistrement de la propriété condominiale en aménagement par étape constitue un lotissement du bien- fonds et crée un lot tel qu’il est décrit dans l’état descriptif de cette étape de l’aménagement. b) in subsection (2) by striking out “a subsequent phase of a phased-development condominium prop- erty” and substituting “an amendment to a declaration and description which creates a subsequent phase of a phased-development condominium property”.

section 27 the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 27 : Names of board members to be provided to the Director Noms des membres du conseil fournis au directeur 27.1(1) Within 15 days after the appointment or election of a director to a board, the corporation shall submit, in a form prescribed by regulation, the name and address of the director to the Director. 27.1(1) Dans les quinze jours de la nomination ou de l’élection d’un administrateur, l’association fournit au di- recteur les nom et adresse de l’administrateur au moyen de la formule réglementaire. 1

section 44 the following: 3 La Loi est modifiée par l’adjonction de ce qui suit après l’article 44 : Amendments to declarations - phased-development condominium property Modification de la déclaration – propriété condominiale en aménagement par étape 44.1(1) Despite subsection 43(1), a declaration may be amended without the consent of the owners of the common elements if the amendment creates a subsequent phase of a phased-development condominium property. 44.1(1) Par dérogation au paragraphe 43(1), la déclara- tion peut être modifiée sans le consentement des proprié- taires des parties communes si la modification a pour effet de créer une étape subséquente d’une propriété condomi- niale en aménagement par étape. 44.1(2) Despite subsection (1), if the development pro- posed in an amendment differs significantly from the de- velopment proposed in the declaration approved by the Director for the phased-development condominium prop- erty, the amendment requires the consent of the owners of the common elements in accordance with

section 43. 44.1(2) Par dérogation au paragraphe (1), si l’aménage- ment proposé dans la modification diffère considérable- ment de l’aménagement proposé dans la déclaration ap- prouvée par le directeur pour la propriété condominiale en aménagement par étape, la modification est subordonnée au consentement des propriétaires des parties communes conformément à l’article 43. 44.1(3) For the purpose of subsection (2), the Director shall determine whether the development proposed in an amendment differs significantly from the development proposed in the declaration he or she approved for the phased-development condominium property. 44.1(3) Aux fins d’application du paragraphe (2), le di- recteur détermine si l’aménagement proposé dans la mo- dification diffère considérablement de l’aménagement proposé dans la déclaration qu’il a approuvée pour la pro- priété condominiale en aménagement par étape.

Amendments to descriptions - phased-development condominium property Modification de l’état descriptif – propriété condominiale en aménagement par étape 44.2(1) Despite subsection 44(1), a description may be amended without the consent of the owners of the common elements if the amendment creates a subsequent phase of a phased-development condominium property. 44.2(1) Par dérogation au paragraphe 44(1), l’état des- criptif peut être modifié sans le consentement des proprié- taires des parties communes si la modification a pour effet de créer une étape subséquente d’une propriété condomi- niale en aménagement par étape. 44.2(2) Despite subsection (1), if the development pro- posed in an amendment differs significantly from the de- velopment proposed in the description approved by the Director for the phased-development condominium prop- erty, the amendment requires the consent of the owners of the common elements in accordance with
