Statute: Public Highways Act Surplus Crown Property Disposal Act

OIC Text: The Governor in Council, on the report and recommendation of the Minister of Public Works dated February 21, 2024, and pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and

Section 11 of

Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, is pleased to: (

a) extinguish the right of the public to use that portion of the public highway, identified as Parcel “A”, containing an area of 1,960 square metres (0.48 acres), more or less, located at or near Comeau's Hill, Yarmouth County, more particularly described in

Schedule “A” and as shown on

Schedule "B" attached to and forming part of the Report and Recommendation; (

b) authorize the conveyance of the parcel of surplus land, Parcel A, to Robert Powell and Doris L. Martinez Powell of Comeau's Hill, Yarmouth County, for the consideration of $2,109.73 plus HST of $316.46 for a total purchase price of $2,426.19; (

c) authorize the Minister of Public Works to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the land herein above described; and (

d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purposes of this Order.
