1 In this regulation, " Act " means The Non-Smokers Health Protection and Vapour Products Act .

Documentation for verifying age

2 Only the following documentation may be used to verify the age of a person for the purposes of subsection 7(3) or 7.0.1(2) of the Act:

(

a) a valid and subsisting driver's licence;

(b) [repealed] M.R. 111/2017 ;

(

c) a passport;

(

d) a certificate of Canadian citizenship that contains the person's photograph;

(

e) a Canadian permanent resident document;

(

f) a Canadian Armed Forces identification card; or

(

g) any other documentation that

(

i) is issued by or under the authority of the government of, or any agency of the government of, any country, province, state, district or territory, and

(ii) contains the person's name, signature, photograph and date of birth.

2 Seuls les documents indiqués ci-dessous peuvent servir à prouver l'âge d'une personne pour l'application du paragraphe 7(3) ou 7.0.1(2) de la Loi :

a) un permis de conduire en vigueur;

b) [abrogé] R.M. 111/2017 ;

c) un passeport;

d) un certificat de citoyenneté canadienne portant sa photographie;

e) un document de résident permanent canadien;

f) une carte d'identité des Forces armées canadiennes;

g) tout autre document :

(

i) délivré par le gouvernement d'un pays, d'une province, d'un État, d'un district ou d'un territoire, par l'un de ses organismes ou sous leur autorité,

(ii) sur lequel figurent son nom, sa signature, sa photographie et sa date de naissance.

3 This regulation comes into force on October 8, 2002.
