Section 1 of the Public Health Act,

chapter P-22.4 of the Acts of New Brunswick, 1998, is amended 1 L’article 1 de la

a) in the French version in paragraph e ) of the definition « système autonome d’évacuation et d’épuration des eaux usées » by striking out the pe ‐ riod at the end of the paragraph and substituting a semi-colon;

a) dans la version française, à l’alinéa e ) de la dé ‐ finition de « système autonome d’évacuation et d’épuration des eaux usées », par la suppression du point à la fin de l’alinéa et son remplacement par un point-virgule; (

b) by adding the following definition in alphabeti ‐ cal order:

Duties of holder of a licence to operate a water circulation system Obligations du titulaire de licence d’exploitation de système de circulation d’eau 24.3(1) A holder of a licence to operate a water circu ‐ lation system shall operate and maintain the water circu ‐ lation system in accordance with the standards and re ‐ quirements prescribed by regulation. 24.3(1) Le titulaire d’une licence d’exploitation de système de circulation d’eau exploite et entretient le sys ‐ tème de circulation d’eau conformément aux normes et selon les conditions prescrites par règlement. 24.3(2) A licence to operate a water circulation system is subject to 24.3(2) La licence d’exploitation de système de circu ‐ lation d’eau est assujettie : (

a) the terms and conditions prescribed by regula ‐ tion, and

b) any additional terms and conditions that the Minister considers appropriate.

b) à toutes autres modalités et conditions que le Mi ‐ nistre estime appropriées. 24.3(3) A holder of a licence to operate a water circu ‐ lation system shall provide a medical officer of health or an inspector with any information they request in respect of the operation and maintenance of the water circulation system. 24.3(3) Le titulaire d’une licence d’exploitation de système de circulation d’eau fournit au médecin- hygiéniste ou à l’inspecteur qui le demande tout rensei ‐ gnement exigé concernant l’exploitation et l’entretien du système de circulation d’eau. 24.3(4) A holder of a licence to operate a water circu ‐ lation system shall maintain, in the form and manner and for the period of time prescribed by regulation, the re ‐ cords and documents prescribed by regulation containing the information prescribed by regulation. 24.3(4) Le titulaire d’une licence d’exploitation de système de circulation d’eau tient, sous la forme, de la manière et pendant la période prescrites par règlement, les registres et les documents prescrits par règlement renfermant les renseignements ainsi prescrits. 24.3(5) On the request of the Minister, a holder of a li ‐ cence to operate a water circulation system shall deliver to the Minister any of the records or documents that the holder is required to maintain. 24.3(5) Le titulaire d’une licence d’exploitation de système de circulation d’eau remet au Ministre, à sa de ‐ mande, les registres ou documents qu’il est tenu de con ‐ server. 24.3(6) A holder of a licence to operate a water circu ‐ lation system shall, 24.3(6) Le titulaire d’une licence d’exploitation de système de circulation d’eau : (

a) in the manner, with the frequency and within the time prescribed by regulation, monitor the water in the water circulation system for the presence or intro ‐ duction into the water of any parameter prescribed by regulation and submit to the Minister, in the manner and within the time prescribed by regulation, a report of the results of the monitoring containing the infor ‐ mation prescribed by regulation, and

a) contrôle, de la manière, à la fréquence et dans le délai prescrits par règlement, la présence ou l’intro ‐ duction dans l’eau du système de circulation d’eau de tout paramètre prescrit par règlement et remet au Mi ‐ nistre, de la manière et dans le délai prescrits par rè ‐ glement, un rapport des résultats du contrôle renfermant les renseignements ainsi prescrits; (

b) if applicable, notify without delay a medical of ‐ ficer of health that the water in the water circulation system contains Legionella bacteria in a quantity or

Section 68 of the Act is amended 3 L’article 68 de la Loi est modifié (
