B.C. Reg. 256/2007, deposited July 19, 2007, pursuant to the FOREST ACT [Section 151 (2) (

n) and (3)]. Order in Council 537/2007, approved and ordered July 18, 2007.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Scaling Regulation, B.C. Reg. 446/94, is amended as set out in the attached Schedule.

Schedule

Section 9 (3) of the Scaling Regulation, B.C. Reg. 446/94, is repealed and the following substituted:

(3) The radius for the purposes of classifying the grade of timber under

section 7 is, if timber is greater than

(a) 12.8 metres in length on the Coast, the radius measured 12.8 metres from the large end of the log, or

(b) 8 metres in length in the Interior, the radius measured at the mid-point of the log.

Section 2 (

f) of the

Schedule of Coast Timber Grades is amended by striking out "No. 5 Utility" and substituting "No. 5 Chipper".

3 Sections 2 (g), 3 (j), 4 (g), 5 (

i) and 6 (

i) are amended by striking out "No. 6 Utility" and substituting "No. 6 Chipper".

4 Sections 2 (h), 3 (k), 4 (h), 5 (

j) and 6 (

j) are amended by striking out "lower in grade than utility" and substituting "lower in grade than No. 6 Chipper".
