B.C. Reg. 10/2009 , deposited January 26, 2009, pursuant to the PUBLIC SECTOR PENSION PLANS ACT [Section 13]. Regulation of the College Pension Board of Trustees, dated January 13, 2009.

The College Pension Board of Trustees orders that, effective September 1, 2009, the College Pension Plan Post Retirement Group Benefit Regulation, B.C. Reg. 490/2003, is amended as set out in the Schedule.

Schedule

Section 2 (1) College Pension Plan Post Retirement Group Benefit Regulation, B.C. Reg. 490/2003, is amended

(

a) by repealing the

definitions of " dental plan ", " extended health care plan " and " pensionable service of the member " and substituting the following:

"dental plan" means the contract for dental care entered into by the board and the carrier that relates to retired plan members and their dependents;

"extended health care plan" means the contract for extended health care entered into by the board and the carrier that relates to retired plan members and their dependents; , and

(

b) by adding the following definition:

"premium" means,

(

a) in relation to the dental plan, the monthly amount of fees or costs payable by the retired plan member for coverage under the dental plan for the member and any of the member's dependents,

(

b) in relation to the extended health care plan, the monthly amount of fees or costs payable by the retired plan member for coverage under the extended health care plan for the member and any of the member's dependents, and

(

c) in relation to the Medical Services Plan, the monthly premium under the Medicare Protection Act payable by the retired plan member for coverage under the Medical Services Plan for the member and any of the member's dependents; .

Section 4 is amended

(

a) in subsection (1) (

b) by striking out " for the portion of " and by adding " under the dental plan " after " required to pay ",

(

b) in subsection (1) (

c) by striking out " monthly contribution to the payment of the premium " and substituting " payment of the monthly premium " and by striking out " required under

section 4 (3) ", and

(

c) by repealing subsections (2) and (3) and substituting the following:

(2) The payment of fees or costs under subsection (1) must be funded by deducting from the retired plan member's pension 100% of the monthly premium for coverage under the dental plan for the member and any of the member's dependents.

Section 5 is amended

(

a) in subsection (1) (

b) by striking out " for the portion of " and by adding " under the extended health care plan " after " required to pay ",

(

b) in subsection (1) (

c) by striking out " monthly contribution to the payment of the premium " and substituting " payment of the monthly premium " and by striking out " required under

section 5 (3) ", and

(

c) by repealing subsections (2) and (3) and substituting the following:

(2) The payment of fees or costs under subsection (1) must be funded by deducting from the retired plan member's pension 100% of the monthly premium for coverage under the extended health care plan for the member and any of the member's dependents.

Section 6 is amended

(

a) in subsection (1) (

b) by striking out " sections 4 (3) and 5 (3) " and substituting " sections 4 (2) and 5 (2) " and by striking out " for the portion of ",

(

b) in subsection (1) (

c) by striking out " contribution to the payment of the ", and

(

c) in subsection (2) by striking out " a monthly contribution of ".

Section 8 is repealed.

Section 9 is amended

(

a) in subsection (1) by striking out " for the individual or aggregate portions of ",

(

b) in subsections (1), (3) and (5) by striking out " sections 4 (3), 5 (3) " and substituting " sections 4 (2), 5 (2) ",

(

c) by repealing subsection (2) and substituting the following:

(2) Despite subsection (1) and sections 4, 5 and 6, a retired plan member

(

a) whose pension effective date is January 1, 2008 or later and whose monthly pension is not or ceases to be sufficient to pay the monthly premiums required under sections 4 (2), 5 (2) and 6 (2), or

(

b) whose pension effective date is before January 1, 2008 and whose monthly pension ceases, after December 31, 2007, to be sufficient to pay the monthly premiums required under sections 4 (2), 5 (2) and 6 (2),

May elect to have coverage under one or both plans referred to in

section 3 (1) (

a) and (

b) by paying directly to the carrier the premium which the member is required under

section 4 (2) or 5 (2) to pay. ,

(

d) in subsection (3) by striking out " contributions " and substituting " premiums ", and

(

e) in subsection (5) by striking out " and must not be paid out of employer contributions in accordance with

section 8 ".
