An Act to Amend the Members’ Conflict of Interest Act Loi modifiant la

Loi sur les conflits d’intérêts des députés et des membres du Conseil exécutif Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1

Section 12 of the Members’ Conflict of Interest Act,

chapter M-7.01 of the Acts of New Brunswick, 1999, is amended 1 L’article 12 de la

Loi sur les conflits d’intérêts des députés et des membres du Conseil exécutif,

chapitre M-7.01 des Lois du Nouveau-Brunswick de 1999, est modifié (

a) by renumbering the

section as subsection 12(1);

a) par la renumérotation de l’article comme étant le paragraphe 12(1); (

b) in subsection (1) by repealing paragraph (a);

b) au paragraphe (1), par l’abrogation de l’ali- néa a); (

c) by adding after subsection (1) the following:

c) par l’adjonction, après le paragraphe (1), de ce qui suit : 12(2) Except as otherwise provided in

section 14, noth- ing in this Act applies to a member of the Assembly by reason of the member receiving a salary, financial assis- tance or other benefit from a registered political party or a registered district association of which he or she is a mem- ber. 12(2) À l’exception des dispositions de l’article 14, rien dans la présente loi ne s’applique à un député pour la seule raison que le député reçoit un salaire, de l’aide financière ou d’autres prestations d’un parti politique enregistré ou d’une association de circonscription enregistrée dont il est membre. 2

Section 14 of the Act is amended 2 L’article 14 de la Loi est modifié (

a) by adding after subsection (2) the following:

Payments from political party or district association Paiements d’un parti politique ou d’une association de circonscription 14(2.1) A member of the Executive Council shall not accept a salary, financial assistance or other benefit from a registered political party or a registered district associa- tion. 14(2.1) Un membre du Conseil exécutif ne doit pas ac- cepter un salaire, de l’aide financière ou d’autres presta- tions d’un parti politique enregistré ou d’une association de circonscription enregistrée. 14(2.2) Notwithstanding subsection (2.1), a member of the Executive Council may be reimbursed by a registered political party or a registered district association for rea- sonable expenses incurred by the member on behalf of the registered political party or registered district association. 14(2.2) Nonobstant le paragraphe (2.1), un membre du Conseil exécutif peut se faire rembourser, par un parti po- litique enregistré ou une association de circonscription enregistrée, les dépenses raisonnables qu’il a engagées en son nom. b) in subsection (4) by striking out “subsection (1)” and substituting “subsections (1) and (2.1)”.
