Labour Relations Board Orders Regulations

made under Sections 5 and 6 of the

Court and Administrative Reform Act

S.N.S. 1996, c. 23

[Note: Effective February 8, 2011, references throughout these regulations to the Labour Relations Board (Nova Scotia) established under

the Trade Union Act should be read as references to the Labour Board established by the Labour Board Act ,

S.N.S. 2010, c. 37, in accordance with

Section 25 of that Act.]

Citation

1 These regulations may be cited as the Labour Relations Board Orders Regulations .

Interpretation

2 In these regulations,

(a) “Board” means the Labour Relations Board (Nova Scotia) established under

the authority of the Trade Union Act ;

(b) “Supreme Court” means the Supreme Court of Nova Scotia.

Filing and enforcement of orders in the Supreme Court

(1) An order of the Board, whether made before or after the coming into force of

Section 5 of the Court and Administrative Reform Act may, for the purpose of

enforcement, be filed with the Supreme Court and shall be enforced in the same

manner as a judgment of that Court.

(2) To file an order referred to in subsection (1) with the Supreme Court, the Chair of

the Board shall make a certified copy of the order, with the following endorsement,

signed by the Chair:

File the enclosed order with the Supreme Court of Nova Scotia.

Chair of the Labour Relations Board

and forward the copy to a prothonotary of the Supreme Court who shall enter it as a

record.

(3) Any subsequent order of the Board rescinding or varying an order of the Board

already filed with the Supreme Court may be filed in the same manner set out in

subsection (2).
