An Act to Amend the Fish and Wildlife Act Loi modifiant la

Loi sur le poisson et la faune Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1 Subsection 1(1) of the Fish and Wildlife Act,

chapter F-14.1 of the Acts of New Brunswick, 1980, is amended 1 Le paragraphe 1 (1) de la

a) by repealing the definition “licence” and substi- tuting the following:

f) of the English version by striking out “or” at the end of the paragraph; (

h) a person who has his or her principal place of res- idence in the Province and is the holder of a valid New Brunswick driver’s licence or a valid photo identifica- tion card issued by the Minister of Public Safety and referred to in the regulations under the Financial Ad- ministration Act;

Section 56 of the Act is amended 2 L’article 56 de la Loi est modifié (

a) in paragraph (1)(

a) by striking out “tag provided with his licence,” and substituting “tag associated with his or her licence”;

b) in subsection (2) by striking out “tag provided with his licence,” and substituting “tag associated with his or her licence”;

section 83 of the Act is repealed and the following is substituted: 3 La rubrique « PERMIS ET LICENCES » qui pré- cède l’article 83 de la Loi est abrogée et remplacée par ce qui suit : REGISTRATION, LICENCES AND PERMITS INSCRIPTION, PERMIS ET LICENCES 4 The Act is amended by adding before

section 83 the following: 4 La Loi est modifiée par l’adjonction de ce qui suit avant l’article 83 : 82.1(1) Before applying for a licence issued under this Act or the regulations and that is prescribed by regulation, a person shall register with the Minister in accordance with this section. 82.1(1) Avant de présenter une demande de l’un des permis délivrés en vertu de la présente loi ou des règle- ments et qui figure sur la liste dressée par règlement, une personne s’inscrit auprès du Ministre conformément au présent article. 82.1(2) Any information prescribed by regulation and required to be submitted for the purposes of registration shall be submitted to the Minister in the form and manner approved by the Minister. 82.1(2) Les renseignements prescrits par règlement qui sont nécessaires à l’inscription sont fournis au Ministre en la forme et selon le mode qu’il approuve. 82.1(3) A registration is valid for the period prescribed by regulation and may be renewed in accordance with the regulations. 82.1(3) L’inscription est valide pour la période prescrite par règlement et peut être renouvelée en conformité avec les règlements.

82.1(4) The Minister shall provide every person who is registered under this

section a unique identification num- ber. 82.1(4) Le Ministre attribue un numéro d’identification unique à quiconque est inscrit en vertu du présent article. 82.1(5) A person who registers under this

section shall update the information required to be submitted for the purposes of registration. 82.1(5) La personne qui s’inscrit en vertu du présent ar- ticle met à jour les renseignements à fournir aux fins d’ins- cription. 82.2 The Minister may disclose any of the information collected for the purpose of registration under

Section 84 of the Act is amended 5 L’article 84 de la Loi est modifié (

a) in paragraph (

a) by striking out “and” at the end of the paragraph;

Section 84.1 of the Act is repealed and the following is substituted: 6 L’article 84.1 de la Loi est abrogé et remplacé par ce qui suit : 84.1 A vendor may retain from the fees collected on be- half of the Minister under this Act or the regulations a commission for the discharge of his or her duties as a ven- dor in an amount determined by the Minister. 84.1 Dans l’exercice de ses fonctions, le vendeur peut retenir la somme que fixe le Ministre à

Section 85 of the Act is repealed and the following is substituted: 7 L’article 85 de la Loi est abrogé et remplacé par ce qui suit : 85(1) A vendor shall require 85(1) Le vendeur exige : (

a) any person required to submit information for the purposes of registration under

section 82.1 to submit that information to him or her before registering that person, and

b) shall return to the Minister the amount of all fees collected on behalf of the Minister under this Act or the regulations, as well as all unsold licences and stubs of licences issued, if any.

c) alters, falsifies or otherwise tampers with a li- cence.

section 82.1, in- cluding the manner in which and the procedure and terms and conditions under which a person may be reg- istered, the information required to be submitted for the purposes of registration, prescribing different classes of registrants, the provision of a unique identification number to those required to register and the require- ments for the use of that number, as well as the renewal, suspension and cancellation of registrations; b.3) régissant l’inscription prévue à l’article 82.1, no- tamment le mode et la procédure d’inscription, les mo- dalités selon lesquelles et les conditions auxquelles le requérant peut être inscrit, les renseignements à fournir aux fins d’inscription, les différentes classes de per- sonnes inscrites, l’attribution d’un numéro d’identifi- cation unique aux personnes tenues de s’inscrire et les exigences relatives à l’utilisation de ce numéro de même que le renouvellement, la suspension et l’annu- lation d’inscriptions; 10 This Act or any provision of it comes into force on a day or days to be fixed by proclamation. 10 La présente loi ou l’une quelconque de ses disposi- tions entre en vigueur à la date ou aux dates fixées par proclamation.
