preamble of the Family Services Act,

chapter F-2.2 of the Acts of New Brunswick, 1980, is amended by adding after the seventh paragraph the following: 1 Le préambule de la

WHEREAS it is recognized that social services pro- vided to children should respect and preserve a child’s need for continuity of care within their kinship network, that a child’s best interests should be included in the as- sessment, planning and decision-making process sur- rounding the permanent plans for the child and that any procedural delay should be avoided as much as possible; and ATTENDU qu’il est reconnu que les services sociaux fournis aux enfants devraient respecter et préserver leurs besoins de continuité de soins au sein de leur réseau de parenté, que le processus d’évaluation, de planification et de prise de décision visant les plans permanents destinés aux enfants devrait s’opérer dans leur intérêt supérieur et que les délais procéduraux devraient être évités le plus possible; et 2

Section 1 of the Act is amended 2 L’article 1 de la Loi est modifié (

a) in the definition “community social services” or “social services”

i) in paragraph (

u) by striking out “and” at the end of the paragraph; (

definitions in alphabet- ical order:

Section 13 of the Act is repealed and the following is substituted: 3 L’article 13 de la Loi est abrogé et remplacé par ce qui suit : 13 The Minister, where he or she considers it to be in the best interests of the child to do so, may prohibit in writing any person from visiting, writing to, telephoning or oth- erwise communicating with a child in care, his or her par- ent, foster parent or kinship caregiver, and any person who violates a prohibition in writing executed under this sec- tion having been given notice of the prohibition, or who otherwise in any way interferes with a child in care without the Minister’s consent, commits an offence. 13 Lorsqu’il estime que l’intérêt supérieur de l’enfant le commande, le Ministre peut interdire par écrit à quiconque de rendre visite, d’écrire ou de téléphoner à un enfant pris en charge, à son parent, à son parent nourricier ou à son parent-substitut ou de communiquer par tout autre moyen avec eux, et commet une infraction toute personne qui, ayant été avisée de l’interdiction écrite souscrite en vertu du présent article, y passe outre ou, sans le consentement du Ministre, s’ingère de toute autre façon dans la vie d’un enfant pris en charge. 4

Section 23 of the Act is amended in the definition “community placement resource” by striking out “a group home” and substituting “a kinship placement home, a child specific placement home, a child care resi- dential centre”. 4 L’article 23 de la Loi est modifié à la définition « cen- tre de placement communautaire » par la suppression de « d’un foyer de groupe » et son remplacement par « d’un foyer d’un parent-substitut, d’un foyer de placement par- ticulier d’un enfant, d’un centre résidentiel pour services de soins aux enfants ». 5 The Act is amended by adding before

section 30 the following: 5 La Loi est modifiée par l’adjonction de ce qui suit avant l’article 30 : 29.2 In this Part, a child who has reached 16 years of age, unless the child is a disabled person, may refuse any protection service established in this Part or by virtue of any regulation created under this Part, unless otherwise ordered by a court. 29.2 Sauf ordonnance judiciaire contraire, dans la pré- sente partie, un enfant qui a seize ans révolus, à moins qu’il soit une personne handicapée, peut refuser tout service de protection établi dans la présente

a) in subsection (1) by striking out “ill-treated” and substituting “ill-treated, including sexual exploitation through child pornography”;

e) by striking out “sexually ex- ploited” and substituting “sexually exploited, includ- ing sexual exploitation through child pornography”;

Section 55 of the Act is amended by adding after subsection (2) the following: 12 L’article 55 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (2) : 55(2.01) For the purposes of subsection (2), time in care of the Minister for children under twelve years of age shall be calculated cumulatively and shall not exceed twenty- four months over a five year period. 55(2.01) Pour l’application du paragraphe (2), la pé- riode pendant laquelle un enfant de moins de douze ans est pris en charge par le Ministre est calculée cumulativement et ne peut dépasser vingt-quatre mois sur une période de cinq ans. 13

Section 143 of the Act is amended by adding after paragraph (d.2) the following: 13 L’article 143 de la Loi est modifié par l’adjonction de ce qui suit après l’alinéa d.2) : (d.3) respecting concurrent plans for the purpose of subsection 31.1(1.1); d.3) concernant le plan concomitant pour l’applica- tion du paragraphe 31.1(1.1); (d.4) prescribing the conditions of eligibility for as- sistance under subsection 31.2(3); d.4) prescrivant les conditions d’admissibilité à l’aide prévue au paragraphe 31.2(3); 14 This Act or any provision of it comes into force on a day or days to be fixed by proclamation. 14 La présente loi ou l’une quelconque de ses disposi- tions entre en vigueur à la date ou aux dates fixées par proclamation.
