An Act to Amend the Quarriable Substances Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows; 1

Section of the Quarriable Substances Act,

chapter Q-1.1 of the Acts of New Brunswick, 1991, is amended by adding after subsection (3) the following: 5(4) No person shall use explosives in the operation of a quarry unless the permit issued under subsection (1) or (2) specifically authorizes the use of explosives as one of the terms and conditions prescribed by the Minister under subsection (3). 5(5) The use of explosives in the operation of a quarry shall be deemed to be an undertaking under the Environ- ment Impact Assessment Regulation - Clean Environment Act. 2 This Act comes into force on a day to be fixed by proclamation. chapitre Q-1.1 des Lois du Nouveau-Brunswick de 1991, est modifié par l’adjonction après le paragraphe (3) de ce qui suit : 5(4) Nul ne doit utiliser d’explosifs dans l’exploitation d’une carrière à moins que le permis délivré en vertu du paragraphe (1) ou (2) autorise expressément l’utilisation d’explosifs parmi les modalités et conditions prescrites par le Ministre en vertu du paragraphe (3). 5(5) L’utilisation d’explosifs dans l’exploitation d’une carrière est réputée un ouvrage au regard du Règlement sur les études d’impact sur l’environnement -

Loi sur l’as- sainissement de l’environnement. 2 La présente loi entre en vigueur à la date fixée par proclamation.
