OIC Text: The Governor in Council on the report and recommendation of the Attorney General and Minister of Justice, dated January 28, 2020, and pursuant to

Section 33 of

Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act ,

Section 4 of

Chapter 42 of the Acts of 2008, the Privacy Review Officer Act , and

Section 10 of

Chapter 70 of the Revised Statutes of Nova Scotia, 1989, the Civil Service Act , is pleased to, effective March 1, 2020: (

a) revoke the appointment of Carmen Stuart, as Acting Review Officer pursuant to

Section 33 of the Freedom of Information and Protection of Privacy Act and as Acting Privacy Review Officer pursuant to

Section 4 of the Privacy Review Officer Act ; (

b) appoint Tricia Ralph as Review Officer pursuant to

Section 33 of the Freedom of Information and Protection of Privacy Act , for a term of five (5) years; (

c) appoint Tricia Ralph as Privacy Review Officer pursuant to

Section 4 of the Privacy Review Officer Act , for a term of five (5) years; (

d) fix the remuneration of Tricia Ralph at $142,925.90 annually in accordance with a salary range equivalent to the Excluded Classification Pay Plan (EC 16) and subject to all applicable pay plan increases to the Excluded Classification Pay Plan (EC 16); (

e) designate Tricia Ralph a deputy head within the meaning of the Civil Service Act ; (

f) direct that benefits and other terms and conditions of Tricia Ralph’s appointment be outlined by contract; (

g) order that the Province shall defend, negotiate or settle claims or charges made against Tricia Ralph and indemnify her from personal liability in connection with any such claim, provided, however, that the Province is satisfied that the claim arises out of her activities in relation to her appointment, and is not based on fraud or criminal activity and where the Province so defends her, the Province will be in control of the case.
