Section 143.1 of the Electricity Act,

chapter E-4.6 of the Acts of New Brunswick, 2003, is amended L’article 143.1 de la

Loi sur l’électricité, chapi- tre E-4.6 des Lois du Nouveau-Brunswick de 2003, est modifié (

a) in subsection (7)

a) au paragraphe (7) (

i) in paragraph (

a) of the English version by striking out “and” at the end of the paragraph; (

i) par la suppression de « and » à fin de l’ali- néa (

a) de la version anglaise; (ii) by striking out the period at the end of the paragraph (

b) and substituting a comma followed by “and”; (ii) par la suppression du point à la fin de l’ali- néa

b) et son remplacement par un point-virgule; (iii) by adding after paragraph (

b) the follow- ing: (iii) par l’adjonction après l’alinéa b ) de ce qui suit : (

c) an offset amount, as determined in accordance with the regulations, that is included in the charges, rates and tolls charged by the Distribution Corporation during the out of service period for the purchase of electricity that, but for the project, would in the normal course have been generated at the Point Lepreau nuclear generating station and supplied to the Distribution Cor- poration by the Nuclear Corporation during the out of service period.

b) in subsection (8), by striking out “shall be deemed to be necessary to carry out the project” and substituting “shall be deemed to be prudent and neces- sary to carry out the project”.

Section of the Act is amended L’article de la Loi est modifié (

a) in subsection (1) by adding after paragraph (l.1) the following:

a) au paragraphe (1), par l’adjonction après l’ali- néa l.1) de ce qui suit : (l.2) determining the offset amount referred to in paragraph 143.1(7)(c); l.2) déterminant le montant pour opérer compensa- tion visé à l’alinéa 143.1(7)c); (

b) in subsection (4) by striking out “paragraph (1)(l.1)” and substituting “paragraph (1)(l.1) or (l.2)”.
