Loi sur la procédure applicable aux infractions provinciales Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1 Subsection 1(1) of the Provincial Offences Proce- dure Act,

chapter P-22.1 of the Acts of New Brunswick, 1987, is amended by adding the following definition in alphabetical order: 1 Le paragraphe 1(1) de la

Loi sur la procédure ap- plicable aux infractions provinciales, chapi- tre P-22.1 des Lois du Nouveau-Brunswick de 1987, est modifié par l’adjonction de la définition qui suit selon l’ordre alphabétique : “firearm” means a firearm as defined in the Criminal Code (Canada); (arme à feu) « arme à feu » s’entend selon la définition que donne de ce terme le Code Criminel (Canada); (firearm) 2 Subsection 128(2) of the Act is repealed and the following is substituted: 2 Le paragraphe 128(2) de la Loi est abrogé et rem- placé par ce qui suit : 128(2) A judge shall order that a defendant be de- tained in custody in order to be dealt with according to law if the prosecutor, having been given an opportunity to do so, satisfies the judge that the detention of the de- fendant is justified on any of the following grounds: 128(2) Le juge ordonne la détention sous garde du dé- fendeur afin qu’il soit traité selon la loi, si le poursui- vant, ayant eu l’occasion de le faire, le convainc que cette détention est justifiée car elle est nécessaire : (

a) the detention is necessary to ensure the defend- ant’s attendance in court in order to be dealt with ac- cording to law;

a) soit pour assurer sa présence à la cour afin qu’il soit traité selon la loi; (

b) the detention is necessary for the protection or safety of the public, including any victim of or wit- ness to the offence, or any minor, having regard to all the circumstances including any substantial likelihood that the defendant will, if released from custody, com-
