VITAL STATISTICS AMENDMENT ACT, 2023

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

CLAUSE 1: [Vital Statistics Act,

section 27]

narrows the requirement for a physician or psychologist to confirm that the sex designation of a person applying for a birth registration amendment does not correspond with the person's gender identity;

is consequential to the amendment by this Bill to

section 36 of the Act.

Section 27 of the Vital Statistics Act, R.S.B.C. 1996, c. 479, is amended

(

a) in subsection (2) (

c) by adding " in the case of a minor who is less than 12 years of age, " before " a statement from one of the following persons ", and

(

b) in subsection (5) by striking out " A birth certificate " and substituting " Except as provided under

section 36 (2) (d), a birth certificate ".

CLAUSE 2: [Vital Statistics Act,

section 36] provides that a person's birth certificate is not required to include the person's sex if the applicant for the certificate requests this.

Section 36 (2) (

d) is repealed and the following substituted:

(

d) the sex of the person, unless the applicant for the certificate requests, as part of the application under subsection (1), that the person's sex not be included; .

Commencement

3 This Act comes into force by regulation of the Lieutenant Governor in Council.
