Interpretation Act Public Service Superannuation Act

OIC Text: The Governor in Council on the report and recommendation of the Minister of Justice dated April 7, 2026, and pursuant to

Section 11 of

Chapter 31 of the Acts of 2004, the Police Act , and

Section 18 of

Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the

Interpretation Act , effective April 9, 2026, hereby: (

a) revokes the appointment of William MacDonald of Annapolis Royal, Annapolis County as the Nova Scotia Police Complaints Commissioner, made by Order in Council 2024-179 dated May 30, 2024; (

b) appoints Jeffrey W. Garber of Halifax Regional Municipality as Acting Nova Scotia Police Complaints Commissioner for a four-month term; (

c) directs that Jeffrey W. Garber continue to be and receive all the benefits of a civil servant during his four-month term, including for the purposes of the Public Service Superannuation Act ; (

d) directs that Jeffrey W. Garber's salary be increased by ten percent for the duration of his appointment; (

e) directs that Jeffrey W. Garber be reimbursed for reasonable expenses incurred in fulfilling his duties as Acting Nova Scotia Police Complaints Commissioner provided such reimbursement does not exceed that normally payable to members of the civil service; and (

f) orders that the Province shall defend, negotiate or settle claims or charges made against Jeffrey W. Garber and indemnify him from personal liability provided that the Province is satisfied the claim arises out of his activities in relation to his appointment as Acting Nova Scotia Police Complaints Commissioner and is not based on fraud or criminal activity and where the Province so defends him, the Province will be in control of the case.
