An Act to Amend the Human Rights Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section 3 of the Human Rights Act,

chapter H-11 of the Revised Statutes, 1973, is amended (

a) by repealing subsection (5); (

b) in subsection (6) (

i) by repealing paragraph (a); (ii) in paragraph (

b) by striking out “or” at the end of the paragraph; (iii) by adding after paragraph (

b) the following: (b.1) the operation of the terms or conditions of any bona fide voluntary early retirement plan; or (

c) by repealing subsection (7) and substituting the following: 3(7) The provisions of subsections (1), (2), (3) and (4) as to physical disability and mental disability do not apply to the operation of the terms or conditions of any bona fide group or employee insurance plan. a) par l’abrogation du paragraphe (5);

b) au paragraphe (6) (

i) par l’abrogation de l’alinéa a); (ii) à l’alinéa b), par la suppression de « ni » à la fin de l’alinéa; (iii) par l’adjonction, après l’alinéa b), de ce qui suit : b.1) à l’application des modalités ou conditions d’un régime effectif de retraite anticipée volontaire; ni

c) par l’abrogation du paragraphe (7) et son rem- placement par ce qui suit : 3(7) Les dispositions des paragraphes (1), (2), (3) et (4), quant à l’incapacité physique et à l’incapacité mentale, ne s’étendent pas à l’application des modalités ou conditions d’un régime effectif d’assurance-groupe ou d’assurance- salariés.

Section 7.01 of the French version of the Act is amended by striking out “un Loi de la Législature” and substituting “une Loi de la Législature”. 6 The Act is amended by adding after

section 7.01 the following: 7.02 Despite any provision of this Act, a limitation, specification, exclusion, denial or preference because of race, colour, religion, national origin, ancestry, place of origin, age, physical disability, mental disability, marital status, sexual orientation, sex, social condition, political belief or activity that is based on a bona fide qualification shall be permitted. 7

Section 10 of the Act is amended (

a) by adding after subsection (3) the following: 10(3.1) The members of the Commission shall hold of- fice for a term to be determined by the Lieutenant- Governor in Council and are eligible for reappointment. (

b) in subsection (4) of the English version by strik- ing out “chairperson” and substituting “Chair”; (

c) by adding after subsection (4) the following: 10(4.1) The Lieutenant-Governor in Council may des- ignate one or two members as Vice-Chairs. 10(4.2) If one member is designated as Vice-Chair, he or she shall act in the place of the Chair if the Chair is un- able to act for any reason. 10(4.3) If two members are designated as Vice-Chairs and the Chair is unable to act for any reason, the Chair shall designate the Vice-Chair to act in his or her place. 2 Le paragraphe 4(4) de la Loi est abrogé. 3 Le paragraphe 5(2) de la Loi est abrogé. 4 Le paragraphe 6(3) de la Loi est abrogé. 5 L’article 7.01 de la version française de la Loi est modifié par la suppression de « un Loi de la Législa- ture » et son remplacement par « une Loi de la Législa- ture ». 6 La Loi est modifiée par l’adjonction après l’article 7.01 de ce qui suit : 7.02 Par dérogation à toute autre disposition de la pré- sente loi, sont autorisés une restriction, une condition, une exclusion, un refus ou une préférence reposant sur la race, la couleur, la croyance, l’origine nationale, l’ascendance, le lieu d’origine, l’âge, l’incapacité physique, l’incapacité mentale, l’état matrimonial, l’orientation sexuelle, le sexe, la condition sociale ou les convictions ou activité politiques qui se fondent sur une qualification réellement requise. 7 L’article 10 de la Loi est modifié

a) par l’adjonction, après le paragraphe (3), de ce qui suit : 10(3.1) Les membres de la Commission sont nommés pour un mandat renouvelable dont la durée est à détermi- ner par le lieutenant-gouverneur en conseil.

b) au paragraphe (4) de la version anglaise, par la suppression de « chairperson » et son remplacement par «C h a i r»;

c) par l’adjonction, après le paragraphe (4), de ce qui suit : 10(4.1) Le lieutenant-gouverneur en conseil peut dési- gner un ou deux vice-présidents parmi les membres. 10(4.2) Dans le cas où un seul vice-président est dési- gné, celui-ci agit à la place du président lorsque le prési- dent est incapable d’agir pour quelque raison que ce soit. 10(4.3) Dans le cas où deux vice-présidents sont dési- gnés et que le président est incapable d’agir pour quelque raison que ce soit, le président désigne un des vice- présidents pour agir à sa place.

An Act to Amend the Human Rights Act Bill 62 10(4.4) If the Chair is unable to make the designation under subsection (4.3), the Lieutenant-Governor in Coun- cil shall designate which Vice-Chair shall act in place of the Chair. (

d) by striking out subsection (5). 8 The Act is amended by adding after

section 10 the following: 10.1 The Chair, Vice-Chair and other members of the Commission shall be paid the remuneration or allowances fixed by the Lieutenant-Governor in Council and shall be reimbursed for expenses incurred in the performance of their duties at a rate to be fixed by the Lieutenant- Governor in Council. 10.2 Despite subsection 10(3.1) and subject to

section 10.3, a member of the Commission remains in office until the member resigns or is reappointed or replaced. 10.3 The appointment of any member of the Commis- sion may be terminated for cause by the Lieutenant- Governor in Council before the expiry of the member’s term. 10.4(1) If a vacancy occurs on the Commission, the Lieutenant-Governor in Council may appoint a person to fill the vacancy for the balance of the term of the Chair, a Vice-Chair or other member replaced. 10.4(2) If a member of the Commission is unable to act due to the temporary absence, illness or incapacity of the member, the Lieutenant-Governor in Council may ap- point a substitute for the member for the period of the tem- porary absence, illness or incapacity. 10.4(3) A vacancy on the Commission does not impair the capacity of the Commission to act if a quorum is main- tained. 10.5 Three members of the Commission constitute a quorum. 9

Section 20 of the English version of the Act is amended (

a) in subsection (2) by striking out “chairperson thereof” and substituting “Chair”; 10(4.4) Si le président est incapable de faire la désigna- tion prévue au paragraphe (4.3), le lieutenant-gouverneur en conseil désigne le vice-président qui agit à la place du président.

d) par l’abrogation du paragraphe (5). 8 La Loi est modifiée par l’adjonction, après l’article 10, de ce qui suit : 10.1 Le président, le vice-président et les autres mem- bres de la Commission reçoivent la rémunération ou les prestations fixées par le lieutenant-gouverneur en conseil et se font rembourser les dépenses qu’ils ont engagées dans l’exercice de leurs fonctions selon le taux fixé par le lieutenant-gouverneur en conseil. 10.2 Par dérogation au paragraphe 10(3.1) et sous ré- serve de l’article 10.3, tout membre de la Commission de- meure en fonction jusqu’à sa démission, le renouvelle- ment de son mandat ou son remplacement. 10.3 Il peut être mis fin au mandat d’un membre de la Commission avant son expiration par le lieutenant- gouverneur en conseil pour motif valable. 10.4(1)

En cas de vacance au sein de la Commission, le lieutenant-gouverneur en conseil peut nommer une per- sonne pour combler cette vacance pour le reste du mandat du président, d’un vice-président ou de tout autre membre de la Commission qui est remplacé. 10.4(2) Le lieutenant-gouverneur en conseil peut, en cas d’absence, de maladie ou d’empêchement temporaire d’un membre de la Commission, lui nommer un suppléant pour la durée de son absence, de sa maladie ou de son em- pêchement temporaire. 10.4(3) Une vacance au sein de la Commission ne porte pas atteinte à sa capacité d’agir pourvu que le quorum soit maintenu. 10.5 Trois membres de la Commission constituent le quorum. 9 L’article 20 de la version anglaise de la Loi est modi- fié

c) in subsection (7) by striking out “chairperson” and substituting “Chair”. 10 Subsection 21(2) of the Act is repealed and the fol- lowing is substituted: 21(2) The Minister or the Commission may publish any order, decision or statement of reasons of a Board of In- quiry in such manner as the Minister or the Commission sees fit. 11 Subparagraph 1(b)(

i) of this Act comes into force on a date to be fixed by proclamation.

Section 1 (

a) The existing provision is as follows: 3(5) Notwithstanding subsections (1), (2), (3) and (4), a limitation, specification or preference on the basis of race, colour, religion, na- tional origin, ancestry, place of origin, age, physical disability, mental disability, marital status, sexual orientation, sex, social condition, po- litical belief or activity shall be permitted if such limitation, specifica- tion or preference is based upon a bona fide occupational qualification as determined by the Commission. (

b) The existing provision is as follows: 3(6) The provisions of subsections (1), (2), (3) and (4) as to age do not apply to (

a) the termination of employment or a refusal to employ because of the terms or conditions of any bona fide retirement or pension plan; (

b) the operation of the terms or conditions of any bona fide re- tirement or pension plan that have the effect of a minimum service requirement; or (

c) the operation of terms or conditions of any bona fide group or employee insurance plan. (

c) The existing provision is as follows: 3(7) The provisions of subsections (1), (2), (3) and (4) as to physical disability and mental disability do not apply to (

a) the termination of employment or a refusal to employ because of a bona fide qualification based on the nature of the work or the circumstance of the place of work in relation to the physical disabil- ity or mental disability, as determined by the Commission; or (

b) the operation of terms or conditions of any bona fide group or employee insurance plan.

Section 2 The existing provision is as follows: 4(4) Notwithstanding subsection (1), a limitation, specification, ex- clusion, denial or preference because of sex, social condition, political belief or activity, physical disability, mental disability, marital status or sexual orientation shall be permitted if such limitation, specification, exclusion, denial or preference is based upon a bona fide qualification as determined by the Commission.

Section 3 The existing provision is as follows: 5(2) Notwithstanding subsection (1), a limitation, specification, ex- clusion, denial or preference because of sex, social condition, political belief or activity, physical disability, mental disability, marital status or sexual orientation shall be permitted if such limitation, specification, NOTES EXPLICATIVES

c) La disposition actuelle se lit comme suit : 3(7) Les dispositions des paragraphes (1), (2), (3) et (4) quant à l’in- capacité physique et à l’incapacité mentale ne s’étendent

a) ni à la cessation d’emploi ou au refus d’emploi pour incapacité physique ou incapacité mentale en raison d’une qualification réel- lement requise qui se fonde sur la nature du travail ou le cadre du lieu de travail, selon ce que détermine la Commission; ou
