OIC Text: The Governor in Council on the report and recommendation of the Minister of Finance dated July 29, 2009, and pursuant to
Section 20 of
Chapter 377 of the Revised Statutes of Nova Scotia, 1989, the Public Service Superannuation Act, is pleased to determine that, pursuant to the devolution by the Nova Scotia Department of Health of certain continuing care coordination and service responsibilities, on, from and after the commencement of employment of those employees of the Nova Scotia Department of Health listed in
Schedule "A" attached to and forming part of the Report and Recommendation (the "non-bargaining unit employees") with any of the South Shore District Health Authority, the South West Nova District Health Authority, the Annapolis Valley District Health Authority, the Colchester East Hants Health Authority, the Cumberland Health Authority, the Pictou County Health Authority, the Guysborough Antigonish-Strait Health Authority, the Cape Breton District Health Authority or the Capital District Health Authority (the "Employers"): (a)the non-bargaining unit employees are, while employed by an Employer, deemed to continue to be persons employed in the public service of the Province for all purposes of the Public Service Superannuation Act, and the service by those non-bargaining unit employees with an Employer is deemed to be service in the public service of the Province for the purpose of the Public Service Superannuation Act; (b)each Employer shall deduct from the salary of the non-bargaining unit employees such amounts as are required under the Public Service Superannuation Act to be deducted from the salary of employees in the public service of the Province, and shall pay the same to the Minister of Finance, and such amounts when so received shall be paid into and form part of the Public Service Superannuation Fund established pursuant to the Public Service Superannuation Act; and (c)whereby the Public Service Superannuation Act a matching payment is directed to be made into the Public Service Superannuation Fund by the Minister of Finance or whereby that Act the superannuation allowance or other sum is directed to be paid out of the Consolidated Fund of the Province, then, in respect of a non-bargaining unit employee, the payment, superannuation allowance or other sum shall be paid by the applicable Employer and shall form part of the annual expenses of the Employer.\x0c
