Definitions Définitions 1 The following

definitions apply in this Act: 1 Les définitions qui suivent s’appliquent à la présente loi. “health care facility” means (

a) a hospital, and (

b) any other facility or class of facility prescribed by regulation. (établissement de soins de santé) “police force” means (

a) a police force established for a local government or for a region, or (

b) the Royal Canadian Mounted Police. ( corps de police) « établissement de soins de santé » S’entend :

b) de la Gendarmerie royale du Canada. ( police force) Non-application of Act Non-application de la présente loi 2 This Act does not apply to 2 La présente loi ne s’applique pas : (

a) a stab wound that is reasonably believed to be self-inflicted or inflicted unintentionally, and

b) a gunshot wound or stab wound that is exempted by regulation or that is inflicted in circumstances pre- scribed by regulation.

Mandatory disclosure of gunshot or stab wounds Déclaration obligatoire des blessures par balle ou par arme blanche 3(1) A health care facility that treats a person for a gunshot or stab wound shall disclose the following infor- mation to the police force responsible for providing po- lice services in the area where the health care facility is located: 3(1) L’établissement de soins de santé qui traite une personne pour blessure par balle ou par arme blanche communique les renseignements qui suivent au corps de police chargé de fournir des services de police dans la région où se trouve cet établissement : (

a) the person’s name, if known;

b) the fact that the person is being treated or has been treated for a gunshot or stab wound; and

c) the name and location of the health care facility.

3(2) A person is considered to have been treated when treatment is offered. 3(2) Le traitement est réputé avoir été reçu dès qu’il est offert. 3(3) Subject to subsection (4), the disclosure required under subsection (1) shall be made orally as soon as the circumstances permit it to be made without interfering with the person’s treatment or disrupting the regular ac- tivities of the health care facility, and in accordance with the requirements prescribed by regulation, if any. 3(3)

Sous réserve du paragraphe (4), la communication exigée au paragraphe (1) est faite de vive voix dès que les circonstances permettent de la faire sans nuire au trai- tement de la personne blessée ni perturber les activités normales de l’établissement de soins de santé et, le cas échéant, selon les exigences établies par règlement. 3(4) The disclosure required under subsection (1) shall be made no later than 24 hours after treatment is offered. 3(4) La communication exigée au paragraphe (1) est faite dans les vingt-quatre heures qui suivent le moment où le traitement est offert. 3(5) Every health care facility shall ensure that a per- son is responsible at all times to make the disclosure re- quired under subsection (1) on behalf of the health care facility. 3(5) Les établissements de soins de santé veillent à ce qu’il y ait en tout temps une personne chargée de faire la communication exigée au paragraphe (1) en leur nom.

Other obligations not affected Incidence sur les autres obligations 4 Nothing in this Act prevents a health care facility from disclosing information to a police force that it is otherwise permitted by law or authorized to disclose. 4 La présente loi n’a pas pour effet d’empêcher un éta- blissement de soins de santé de communiquer à un corps de police les renseignements qu’il est par ailleurs autori- sé à communiquer, notamment par la loi.

Immunity Immunité 5 No action or other proceeding lies or shall be insti- tuted against a health care facility or any person acting under the authority of this Act for anything done or omitted to be done, in good faith, in the exercise or in- tended exercise of a power or duty under this Act. 5 Bénéficient de l’immunité de poursuite engagée par voie d’action ou autre instance les établissements de soins de santé et les personnes qui agissent sous l’auto- rité de la présente loi pour les actes accomplis ou les omissions commises de bonne foi dans l’exercice effectif ou censé tel des pouvoirs et fonctions que leur confère la présente loi.

Administration Application 6 The Minister of Public Safety is responsible for the administration of this Act and may designate one or more persons to act on the Minister’s behalf. 6 Le ministre de la Sécurité publique est chargé de l’application de la présente loi et peut désigner une ou plusieurs personnes pour le représenter. Regulations Règlements 7 The Lieutenant-Governor in Council may make reg- ulations: 7 Le lieutenant-gouverneur en conseil peut, par règle- ment : (

a) prescribing facilities or classes of facilities for the purposes of the definition “health care facility”;

c) prescribing circumstances in which a gunshot or stab wound is exempted from the application of this Act;

d) prescribing requirements respecting disclosure for the purposes of subsection 3(3);
