General information about corrections and minor changes
The Statutes and Regulations Act requires Manitoba legislation to be published on the Manitoba Laws website. Under subsection 25(1) of the Act, the chief legislative counsel is required to correct consolidation and publication errors.
Under subsection 25(2) of the Act, the chief legislative counsel may make minor corrections or changes to the consolidated version of
an Act or regulation without changing its legal effect.
Notice of the following types of minor changes must be given:
replacing a description of a date or time with the actual date or time; [s. 25(2)(f)]
replacing a reference to a bill or any part of a bill with a reference to the resulting Act or part of the Act after the bill is enacted and assigned a
chapter number; [s. 25(2)(g)]
removing a reference to a contingency in a provision that is stated to come into effect when or if that contingency occurs, if that contingency has occurred, or is required as a result of removing such a reference; [s. 25(2)(h)]
updating a reference to a person, office, organization, place or thing if
an Act provides that references to it are deemed or considered to be references to another person, office, organization, place or thing; [s. 25(2)(i)]
updating a reference to reflect a change in the name, title, location or address of a person, office, organization, place or thing, other than
a change in the name or title of a document adopted or incorporated by reference unless it was adopted or incorporated as amended from time to time, and
a change in the title of a minister or the name of a department; [s. 25(2)(j)]
updating a reference to a minister or department when, under subsection 5(3) of The Executive Government Organization Act , the Act is to be read as if it were amended as necessary to give effect to an order in council made under that Act; [s. 25(2)(k)]
correcting an error in the numbering of a provision or other portion of
an Act, or making a change to a cross-reference required as a result of such a correction; [s. 25(2)(l)]
correcting an obvious error in a cross-reference, if it is obvious what the correction should be; [s. 25(2)(m)]
if a provision of a transitional nature is contained in an amending Act, incorporating it as a provision of the consolidated Act and make any other changes that are required as a result; [s. 25(2)(n)]
removing a provision that is deemed by The
Interpretation Act to have been repealed because it has expired, lapsed or otherwise ceased to have effect. [s. 25(2)(o)]

Definitions
1 The following
definitions apply in this regulation.
"Act" means The Transportation Infrastructure Act . (« Loi »)
"agricultural use" means use for the primary purpose of
(
a) growing crops or fodder for use or for sale;
(
b) raising livestock or poultry for sale;
(
c) operating a poultry establishment for the production of eggs for sale;
(
d) operating a mink or fox establishment maintained for their pelts for sale or for sale as breeding stock;
(
e) operating a dairy establishment maintained for the production of milk or cream for sale;
(
f) operating a feed lot upon which cattle are kept or fed for marketing;
(
g) operating an apiary of hives of bees maintained for the production of honey for sale. (« usage agricole »)
"billboard sign" means a sign other than a portable sign. (« panneau-réclame »)
"commercial use" means use for the primary purpose of conducting
(
a) a commercial activity; or
(
b) a not-for-profit activity that is not a public use. (« usage commercial »)
"portable sign" means a sign that
(
a) is designed to be moveable and intended for temporary installation; or
(
b) is designed to be permanently mounted and
(
i) is erected wholly on an applicant's land, or
(ii) does not exceed 8 m 2 in surface area. (« panneau portatif »)
"prime lending rate" means the prime lending rate of the Royal Bank of Canada. (« taux préférentiel »)
"public use" means use for the primary purpose of
(
a) local government administration;
(
b) emergency services;
(
c) community services;
(
d) operating a place of worship;
(
e) operating an educational institution;
(
f) operating a community centre; or
(
g) operating a registered charity as defined in subsection 248(1) of the Income Tax Act (Canada). (« usage public »)
"residential use" means use for the primary purpose of single residential or multi-residential occupancy. (« usage résidentiel »)
"utility" means equipment operated for the primary purpose of supplying electricity, natural gas, oil and petroleum products, telecommunications, water or wastewater services. (« équipement »)

1 Les définitions qui suivent s'appliquent au présent règlement.
« équipement » Équipement qui sert principalement à la fourniture d'électricité, de gaz naturel, de pétrole et de produits pétroliers ou de télécommunications, à l'approvisionnement en eau ou à l'évacuation des eaux usées. ("utility")
« Loi » La
Loi sur les infrastructures de transport . ("Act")
« panneau portatif » Panneau conçu :
a) soit pour être déplacé et pour être installé de manière temporaire;
b) soit pour être installé de manière permanente et répondant à un des critères suivants :
(
i) il est placé entièrement sur le bien-fonds de l'auteur d'une demande,
(ii ) son aire n'excède pas 8 m 2 . ("portable sign")
« panneau-réclame » Panneau-réclame qui n'est pas un panneau portatif. ("billboard sign")
« taux préférentiel » Taux préférentiel pratiqué par la Banque Royale du Canada. ("prime lending rate")
« usage agricole » Usage réservé principalement à l'une des activités suivantes :
a) culture de plantes alimentaires ou de fourrage pour son propre usage ou pour la vente;
b) élevage d'animaux ou de volaille pour la vente;
c) exploitation d'un établissement avicole pour la production d'œufs destinés à la vente;
d) exploitation d'un établissement où sont élevés des visons ou des renards pour la vente de leur fourrure ou pour les vendre à
titre de reproducteurs;
e) exploitation d'un établissement laitier en vue de la production du lait ou de la crème pour la vente;
f) exploitation d'un parc d'engraissement où le bétail est entretenu ou engraissé pour la commercialisation;
g) exploitation d'une ferme apicole en vue de la production du miel pour la vente. ("agricultural use")
« usage commercial » Usage réservé principalement à l'exercice :
a) soit d'une activité commerciale;
b) soit d'une activité sans but lucratif qui ne constitue pas un usage public. ("commercial use")
« usage public » Usage réservé principalement à une des fins suivantes :
a) administration locale;
b) services d'urgences;
c) services communautaires;
d) gestion d'un lieu de culte;
e) exploitation d'un établissement d'enseignement;
f) gestion d'un centre communautaire;
g) exploitation d'un organisme de bienfaisance enregistré au sens du paragraphe 248(1) de la Loi de l'impôt sur le revenu (Canada). ("public use")
« usage résidentiel » Usage réservé principalement au logement individuel ou collectif. ("residential use")

Forgoing the lowest compliant bid
2 For the purpose of clause 9(3)(
b) of the Act (forgoing the lowest compliant bid), the amount prescribed is $50,000.

Rate of interest on holdbacks
3(1) Subject to subsection (2), the interest payable on holdbacks under subsection 10(3) of the Act is the prime lending rate less 4%, adjusted on January 1 and July 1 of each year and determined as follows:
(
a) for a January 1 interest adjustment, the interest rate is calculated based on the prime lending rate in effect the previous December 1;
(
b) for a July 1 interest adjustment, the interest rate is calculated based on the prime lending rate in effect the previous June 1.
Intérêts sur les retenues
3(1)
Sous réserve du paragraphe (2), l'intérêt exigible sur les retenues en vertu du paragraphe 10(3) de la Loi est calculé au taux préférentiel moins 4 %, lequel est rajusté le 1 er janvier et le 1 er juillet de chaque année et déterminé comme suit :
a) si le rajustement de l'intérêt est effectué le 1 er janvier, le taux d'intérêt est calculé en fonction du taux préférentiel en vigueur le 1 er décembre précédent;
b) si le rajustement de l'intérêt est effectué le 1 er juillet, le taux d'intérêt est calculé en fonction du taux préférentiel en vigueur le 1 er juin précédent.
3(2) If the interest rate calculated in accordance with subsection (1) is less than 0.5%, the interest rate payable on the holdback is 0.5%.

4 For the purpose of clause 13.1(3)(
a) of the Act (authorization of certain leases), the prescribed amount is $25,000.

4.1 For the purpose of
section 13.3 of the Act (disposal of personal property), the prescribed amount in relation to the sale of personal property is $25,000.

Permit Application Fees
5 The following fees are prescribed for the purposes of the Act:
(
a) portable sign permit
$150;
(
b) billboard sign permit
$500;
(
c) access permit — agricultural use, public use or residential use
$300;
(
d) access permit — commercial use
$500;
(
e) controlled area structure permit — agricultural use, public use or residential use
$300;
(
f) controlled area structure permit — commercial use
$500;
(
g) permit to locate utility in right-of-way
$500.

5 Pour l'application de la Loi , les droits exigibles à l'égard des types de permis indiqués ci-dessous sont les suivants :

COMING INTO FORCE

Coming into force
6 This regulation comes into force on the same day that
Schedule A of The Traffic and Transportation Modernization Act , S.M. 2018, c. 10, comes into force.
