MOTOR VEHICLE (BANNING SMOKING WHEN CHILDREN PRESENT) AMENDMENT ACT, 2008

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Part 4 of the Motor Vehicle Act , R.S.B.C. 1996, c. 318, is amended by adding the following section:

Smoking in motor vehicle prohibited

231.1

(1) In this section, "tobacco" means tobacco leaves or products produced from tobacco in any form or for any use.

(2) A person must not smoke tobacco, or hold lighted tobacco, in a motor vehicle that is occupied by a person under the age of 16 years, whether or not any window, sunroof, car-top, door or other feature of the vehicle is open.

(3) A person who contravenes subsection (2) commits an offence.

(4) The Lieutenant Governor in Council may make regulations exempting any person or class of persons from the requirements of this

section and prescribing conditions for those exemptions.

Commencement

2 This Act comes into force by regulation of the Lieutenant Governor in Council.
