FAMILY RELATIONS AMENDMENT ACT, 1998

Section 24 of the Family Relations Act, R.S.B.C. 1996, c. 128, is amended by adding the

following subsection:

(1.1) The references to "other persons" in subsection (1) (

c) and to "each person" in

subsection (1) (

e) include parents, grandparents, other relatives of the child and

persons who are not relatives of the child.

Section 35 is amended by adding the following subsection:

(1.1) The reference to "persons" in subsection (1) includes parents, grandparents, other

relatives of the child and persons who are not relatives of the child.

Commencement

3 This Act comes into force by regulation of the Lieutenant Governor in Council.

Explanatory Notes

SECTION 1: [Family Relations Act, adds

section 24 (1.1)] provides express reference to

parents, grandparents and other relatives of the child in the rule respecting a

court's determination of the best interests of a child.

SECTION 2: [Family Relations Act, adds

section 35 (1.1)] provides express reference to

parents, grandparents and other relatives of the child in the court's power to

make orders respecting custody and access to a child.
