1 The Highway 12/21 Regional Water Services
Commission Regulation (AR 195/2006) is amended by this
Regulation.
Section 2 is repealed and the following is substituted:

a) Camrose County;

b) Town of Bashaw;
(
c) Village of Alix;
(
d) Village of Clive;
(
e) Village of Edberg;
(

Income and Employment Supports Act
INCOME SUPPORTS, HEALTH AND TRAINING BENEFITS
AMENDMENT REGULATION

section 18 of the Income and Employment Supports
Act.
1 The Income Supports, Health and Training Benefits
Regulation (AR 60/2004) is amended by this Regulation.
Section 1(1) is amended by repealing clauses (r), (
s) and
(u).
Section 6 is amended
(
a) by repealing subsections (1) and (1.1) and
substituting the following:
Financial resource availability
6(1) In this section,
(a) "cash gift of a non-recurring nature" includes payments
made by a First Nation, in equal amounts, to each
person on the Band List of the First Nation but does not
include payments described in subsection (4)(a)(xxii);
(b) "income" means
(
i) gross self-employment income less employment
deductions and
(
A) the reasonable cost of materials, supplies,
goods and services that are essential to a
business operation, or
(
B) in the case of a child care services income
from a home-based business, the cost of food
and safety items required for the children in
care and any other costs incurred as a
requirement of a contract with a family day
home agency,
(ii) gross employment income less
(
A) employment deductions,
(
B) any deductions required by an employer as a
condition of employment, and
(
C) where the person's wages are garnished, for
only the first month after the garnishment is
in effect, the amount of the first payment that
is paid pursuant to the summons,
and
(iii) all other sources of income.
(
b) in subsection (4)
(
i) in clause (
a) by adding the following after
subclause (xxii):
(xxiii) employment income of a full-time learner member
of a household unit;
(ii) in clause (b)
(
A) by striking out "income from the following
sources" and substituting "the following
income";
(
B) by repealing subclause (iii) and
substituting the following:
(iii) employment income,
(
A) with respect to income earned by a
member of a household unit designated
in the full-time learner category, if the
member is designated as expected to
work or not expected to work, the first
$230 plus 25% of the remainder per
month of the projected average monthly
income during the training period;
(
B) with respect to income earned by an
adult member of a household unit
designated in the expected to work or
not expected to work categories,
(
I) if the household unit has one adult
member and a member who is a
dependant child, the first $230 plus
25% of the remainder per month,
and
(II) if the household unit is not
described in paragraph (A), the
first $115 plus 25% of the
remainder per month;
(iii.1) self-employment income from a home-based
business earned by a not expected to work
member of a household unit as follows:
(
A) with respect to a household unit
designated in the full-time learner
category, the first $230 plus 25% of the
remainder per month of the projected
average monthly income during the
training period;
(
B) with respect to a household unit
designated in the expected to work or
not expected to work categories,
(
I) if the household unit has one adult
member and a member who is a
dependant child, the first $230 plus
25% of the remainder per month,
and
(II) if the household unit is not
described in subparagraph (I), the
first $115 plus 25% of the
remainder per month;
(iii.2) child care services income from a
home-based business,
(
A) with respect to income earned by a
member of a household unit designated
in the full-time learner category, the first
$230 plus 25% of the remainder per
month of the projected average monthly
income during the training period, and
(
B) with respect to income earned by a
member of a household unit designated
in the expected to work or not expected
to work categories,
(
I) if the household unit has one adult
member and a member who is a
dependant child, the first $230 plus
25% of the remainder per month,
and
(II) if the household unit is not
described in subparagraph (I), the
first $115 plus 25% of the
remainder per month;
(iii.3) employment or, if from a home-based
business, self-employment income earned by
a dependent child of a household unit who is
not attending school, the first $350 plus 25%
of the remainder per month.
(
c) by adding the following after subsection (4):
(5) Subsection (4)(
b) does not apply for the purpose of
determining initial eligibility under
section
Section 34 is amended
(
a) in subsection (3) by repealing clause (
c) and
substituting the following:
(
c) the household unit has liquid assets that exceed $5000.
(
b) in subsection (5)(
a) by striking out "$1200 per
academic term, for a maximum of 3 terms per academic year,
and" and substituting "$5000 per academic year, and";
(
c) in subsection (6) by striking out "$1200 per academic
term, for a maximum of 3 terms per academic year" and
substituting "$5000 per academic year".
5 This Regulation comes into force on September 1, 2007.

Definitions
1 In this Regulation,
(a) "audit committee" means the audit committee established
under
section 10 of the Act;
(b) "bylaws" means the bylaws made by the board of directors
under
section 9 of the Act;
(c) "director" means a member of the board of directors
appointed under
section 4(1)(
a) of the Act.
Annual retainers
2(1) A director shall be paid a retainer in the amount of $20 000 per
year during the director's term of appointment as a director.
(2) A director who is designated as chair of the board under
section
4(2) of the Act shall be paid, in addition to the retainer referred to in
subsection (1), a retainer in the amount of $50 000 per year during that
director's designation as chair.
(3) A director who is appointed as vice-chair of the board in
accordance with the bylaws shall be paid, in addition to the retainer
referred to in subsection (1), a retainer in the amount of $10 000 per
year during that director's appointment as vice-chair.
(4) A director who is appointed in accordance with the bylaws as chair
of the audit committee shall be paid, in addition to the retainer referred
to in subsection (1), a retainer in the amount of $10 000 per year
during that director's appointment as chair.
(5) A director who is appointed in accordance with the bylaws as chair
of a committee established by the board shall be paid, in addition to the
retainer referred to in subsection (1), a retainer in the amount of $7500
per year during that director's appointment as chair.
Board meetings
3 A director shall be paid $1000 for each day during which the
director participates in meetings of the board of directors.
Committee meetings
4 A director shall be paid $1000 for each day during which the
director participates in meetings of a committee established by the
board.
Coming into force
5 This Regulation comes into force on the coming into force of the
Alberta Investment Management Corporation Act.

Regulation (AR 307/91) is repealed.
2 This Regulation comes into force on the coming into
force of the Bow, Oldman and South Saskatchewan River
Basin Water Allocation Order.

Family Law Act
ALBERTA CHILD SUPPORT GUIDELINES AMENDMENT REGULATION

section 107 of the Family Law Act.
1 The Alberta Child Support Guidelines (AR 147/2005) are
amended by this Regulation.
Section 2(1) is amended by adding the following after
clause (g):
(h) "universal child care benefit" means a benefit provided under
section 4 of the Universal Child Care Benefit Act (Canada).
Section 7(3) is repealed and the following is substituted:
(3) Subject to subsection (4), in determining the amount of an
expense referred to in subsection (1), the court must take into
account any subsidies, benefits or income tax deductions or credits
relating to the expense, and any eligibility to claim a subsidy, benefit
or income tax deduction or credit relating to the expense.
(4) In determining the amount of an expense referred to in
subsection (1), the court shall not take into account any universal
child care benefit or any eligibility to claim that benefit.
Schedule 3 is amended
(
a) by repealing
section 3 and substituting the
following:
Spousal or adult interdependent partner support
3 To calculate income for the purpose of determining an
amount under an applicable table, deduct
(
a) the spousal or adult interdependent partner support
received from the other parent, and
(
b) any universal child care benefit that is included to
determine the other parent's total income in the T1
General form issued by the Canada Revenue Agency.
(
b) by repealing
section 4 and substituting the
following:
Special or extraordinary expenses
4 To calculate income for the purpose of determining an
amount under
section 7 of these Guidelines, deduct the spousal
or adult interdependent partner support paid to the other parent
and, as applicable, make the following adjustment in respect of
universal child care benefits
(
a) deduct benefits that are included to determine the
parent's total income in the T1 General form issued by
the Canada Revenue Agency and that are for a child for
whom special or extraordinary expenses are not being
requested, or
(
b) include benefits that are not included to determine the
parent's total income in the T1 General form issued by
the Canada Revenue Agency and that are received by
the parent for a child for whom special or extraordinary
expenses are being requested.
5 The following provisions are amended by striking out
"Canada Customs and Revenue Agency" and by substituting
"Canada Revenue Agency":
section 16(a);

b) of
Schedule 2;
section 2 of
Schedule 3.

PROVINCIAL COURT JUDGES AND MASTERS IN CHAMBERS
COMPENSATION AMENDMENT REGULATION

section 9.52(1) of the Provincial Court Act and
sections 8 and 16 of the Court of Queen's Bench Act.
1 The Provincial Court Judges and Masters in Chambers
Compensation Regulation (AR 176/98) is amended by this
Regulation.
Section 1 is amended
(
a) in subsection (4) by adding "unless subsection
(4.1) applies" after "full-time judge";
(
b) by adding the following after subsection (4):
(4.1) The salary to be paid to a part-time judge for a term of
appointment that commences on the 183rd day after the judge's
birthday is 25% of the amount payable to a full-time judge.
(
c) by adding the following after subsection (5):
(5.1) Where
(
a) the part-time judge's initial term of appointment
commences on the 183rd day after the judge's birthday,
and
(
b) the aggregate of the part-time judge's salary and
pension benefits payable during the initial term exceeds
50% of the annual salary of a full-time judge for that
period,
the salary payable to the part-time judge for the initial term shall
be reduced by the amount exceeded.
(
d) in subsection (6) by striking out "subsection (5)" and
substituting "subsections (5) and (5.1)".
Schedule 1 is amended
(
a) in
section 3(1) by striking out "during the two 3-month
periods they are required to serve" and substituting
"except where a part-time judge's initial term of appointment
commences on the 183rd day after the judge's birthday, in
which case the judge is entitled to vacation of only 7.5
working days for that term of appointment";
(
b) in
section 4 by striking out "two 3-month".

Definitions
1 In this Order,
(a) "Act" means the Water Act;
(b) "Bow River Basin" means the Bow River and its tributaries
and the water below the ground naturally flowing to and from
the Bow River and its tributaries, within Alberta;
(c) "First Nation" means the Siksika Nation, Tsuu T'ina Nation,
Piikani Nation, Kainai Nation or the Stoney (Bearspaw,
Chiniki, Wesley) Nation, each of which is a band within the
meaning of the Indian Act (Canada);
(d) "First Nation Reserve" means a reserve within the meaning
of the Indian Act (Canada) that is located within the Bow
River Basin, the Oldman River Basin or the South
Saskatchewan River Basin and that has been set apart for the
use and benefit of a First Nation;
(e) "Oldman River Basin" means the Oldman River and its
tributaries and the water below the ground naturally flowing
to and from the Oldman River and its tributaries, within
Alberta;
(f) "South Saskatchewan River Basin" means the South
Saskatchewan River and its tributaries, from the confluence
of the Bow River and the Oldman River to the border
between Alberta and Saskatchewan, and the water below the
ground naturally flowing to and from that part of the South
Saskatchewan River and its tributaries, within Alberta.
Reservation
2 All the water in the Bow River Basin, Oldman River Basin and
South Saskatchewan River Basin that is not, on the date this Order is
filed under the Regulations Act, allocated under a licence or
registration or specified in a preliminary certificate is reserved.
Allocation
3 Water reserved under
section 2 may be allocated by the Director.
Bow River Basin
4(1) The Director may issue licences with respect to the Bow River
Basin in accordance with the following:
(
a) for use by a First Nation
(
i) on a First Nation Reserve, or
(ii) for a project that is partially or wholly owned and
operated by the First Nation on land that
(
A) is wholly owned in fee simple by a corporation or
limited partnership wholly owned and controlled
by the First Nation, and
(
B) is capable of being served by the Bow River Basin;
(
b) for a water conservation objective;
(
c) for storage, if it is for the protection of the aquatic
environment and for improving the availability of water to
existing licence holders and registrants;
(
d) for any purpose, if, on or before the date this Order is filed
under the Regulations Act, an application for the licence that
is complete and complies with the Act has been filed with the
Director.
(2) The Director may effect a registration with respect to the Bow
River Basin if, on or before the date this Order is filed under the
Regulations Act, an application for the registration that is complete and
complies with the Act has been filed with the Director.
Priority number
5(1) The priority number of a licence issued pursuant to
section
4(1)(
a) is the date that this Order is filed under the Regulations Act.
(2) The priority number of a licence issued pursuant to
section 4(1)(
b) is one day after the date that this Order is filed under the Regulations
Act.
(3) The priority number of a licence issued pursuant to
section 4(1)(
c) or (
d) must be determined in accordance with
section 29 of the Act.
(4) The priority number of a registration effected pursuant to
section
4(2) must be determined in accordance with
section 28 of the Act.
Oldman River Basin
6(1) The Director may issue licences with respect to the Oldman
River Basin in accordance with the following:
(
a) for use by a First Nation
(
i) on a First Nation Reserve, or
(ii) for a project that is partially or wholly owned and
operated by the First Nation on land that
(
A) is wholly owned in fee simple by a corporation or
limited partnership wholly owned and controlled
by the First Nation, and
(
B) is capable of being served by the Oldman River
Basin;
(
b) for a water conservation objective;
(
c) for storage, if it is for the protection of the aquatic
environment and for improving the availability of water to
existing licence holders and registrants;
(
d) for any purpose, if, on or before the date this Order is filed
under the Regulations Act, an application for the licence that
is complete and complies with the Act has been filed with the
Director;
(
e) if an application for a licence is made that relates to the Little
Bow Project/Highwood Diversion Plan within the provisions
for the project as set out by the Natural Resources
Conservation Board/Canadian Environmental Assessment
Agency Joint Review Panel regarding NRCB
Application 9601, May 1998;
(
f) if an application for a licence is made that relates to the Pine
Coulee Water Management Project within the provisions for
the project as set out by the Natural Resources Conservation
Board/Environmental Assessment Review Process Joint
Review Panel regarding NRCB Application 9401, February
(2) The Director may effect a registration with respect to the Oldman
River Basin if, on or before the date this Order is filed under the
Regulations Act, an application for the registration that is complete and
complies with the Act has been filed with the Director.
Priority number
7(1) The priority number of a licence issued pursuant to
section
6(1)(
a) is the date that this Order is filed under the Regulations Act.
(2) The priority number of a licence issued pursuant to
section 6(1)(
b) is one day after the date that this Order is filed under the Regulations
Act.
(3) The priority number of a licence issued pursuant to
section 6(1)(c),
(d), (
e) or (
f) must be determined in accordance with
section 29 of the
Act.
(4) The priority number of a registration effected pursuant to
section
6(2) must be determined in accordance with
section 28 of the Act.
South Saskatchewan River Basin
8(1) The Director may issue licences with respect to the South
Saskatchewan River Basin in accordance with the following:
(
a) for use by a First Nation
(
i) on a First Nation Reserve, or
(ii) for a project that is partially or wholly owned and
operated by the First Nation on land that
(
A) is wholly owned in fee simple by a corporation or
limited partnership wholly owned and controlled
by the First Nation, and
(
B) is capable of being served by the South
Saskatchewan River Basin;
(
b) for a water conservation objective;
(
c) for storage, if it is for the protection of the aquatic
environment and for improving the availability of water to
existing licence holders and registrants;
(
d) for any purpose, if, on or before the date this Order is filed
under the Regulations Act, an application for the licence that
is complete and complies with the Act has been filed with the
Director.
(2) The Director may effect a registration with respect to the South
Saskatchewan River Basin if, on or before the date this Order is filed
under the Regulations Act, an application for the registration that is
complete and complies with the Act has been filed with the Director.
Priority number
9(1) The priority number of a licence issued pursuant to
section
8(1)(
a) is the date that this Order is filed under the Regulations Act.
(2) The priority number of a licence issued pursuant to
section 8(1)(
b) is one day after the date that this Order is filed under the Regulations
Act.
(3) The priority number of a licence issued pursuant to
section 8(1)(
c) or (
d) must be determined in accordance with
section 29 of the Act.
(4) The priority number of a registration effected pursuant to
section
8(2) must be determined in accordance with
section 28 of the Act.

10 Nothing in this Order affects the Oldman River Basin Water
Allocation Order (AR 319/2003).
