OIC Text: The Governor in Council on the report and recommendation of the Minister of Natural Resources dated January 4, 2012, and pursuant to clause 16(1)(

a) of

Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act is pleased to: (

a) approve a lease by the Minister of Natural Resources for submerged Crown land containing approximately 215.0 hectares (531.0 acres), the exact location and acreage as determined by survey, located at Minas Passage, near Black Rocks, Cumberland County, And shown outlined in bold on the plan marked

Schedule "A", attached to and forming part of the Report and Recommendation, to the Fundy Ocean Research Center for Energy Limited, a body corporate with its registered office at Halifax, Halifax County, its successors, trustees, and permitted assigns, for the purpose of demonstrating and testing in-stream tidal devices, and for no other purpose, for a term of ten (10) years at the annual rent of $1,204 plus an administration fee, with the right to renew the lease for a further ten (10) year term at rent and fees to be fixed by the Department of Natural Resources at that time, and provided that the Company has satisfactorily complied with the terms and conditions of the lease; and (

b) execute such documents as to achieve the purposes of this Order.
