B.C. Reg. 117/2010 , deposited April 30, 2010, pursuant to the HEALTH PROFESSIONS ACT [Section 12 (2)]. Ministerial Order M126/2010, dated April 30, 2010.

I, Kevin Falcon, Minister of Health Services, order that, effective May 1, 2010, the Optometrists Regulation, B.C. Reg. 33/2009, is amended as set out in the attached Schedule.

Schedule

Section 1 of the Optometrists Regulation, B.C. Reg. 33/2009, is amended

(

a) in the definition of " contact lens record " by adding " , prepared by a person authorized under the Act to fit a contact lens ," after " the record ",

(

b) in paragraph (

b) of the definition of " dispense " by striking out " adjust " and substituting " fit, adjust, verify " and by striking out " the vision appliance ",

(

c) in the definition of " fit " by adding " , in respect of a contact lens, " after " means ",

(

d) in the definition of " optometry " by striking out " and " at the end of paragraph (a), by adding " , and " at the end of paragraph (b) (iii) and by adding the following paragraph:

(

c) dispensing vision appliances; ,

(

e) in the definition of " prescription for a corrective eyeglass lens " by striking out everything before paragraph (

a) and substituting the following:

"prescription for a corrective eyeglass lens" means the record, derived from an eye health examination and prepared by a registrant, of an authorization to dispense a corrective eyeglass lens for use by a named individual, that sets out ,

(

f) in the definition of " qualified medical practitioner " by striking out everything after " who is " and substituting " authorized under the Act to provide eye and vision system health services; ",

(

g) in the definition of " verify " by striking out " objectively ", and

(

h) by repealing the definition of " optician " and adding the following

definitions:

"interpupillary distance" means one or more measurements of the distance between the pupils of the eyes, as will be required for the proper fitting of corrective eyeglasses;

"prescription" means, in respect of a vision appliance, the record of an authorization to dispense for use by a named individual, but does not include a contact lens record;

"supply" does not include a wholesale transaction; .

Section 5 is amended

(

a) in subsection (1) by repealing paragraph (

i) and substituting the following:

(

i) supply a contact lens for the purpose of fitting a contact lens. , and

(

b) by adding the following subsections:

(3) The following services May be provided only by registrants or under the supervision of a registrant by persons who are not registrants:

(

a) fitting a contact lens;

(

b) supplying a contact lens for the purpose of fitting a contact lens.

(4) Despite subsection (2), nothing in this regulation prevents a person from doing anything described in

section 5 (3) of the Opticians Regulation.

Section 6 is amended

(

a) in subsection (3) by striking out everything before paragraph (

a) and substituting the following:

(3) A registrant must provide, free of charge, a legible written or electronic copy of the following to the named individual, whether or not requested by the named individual, and to another person specified by the named individual, if requested by the named individual: ,

(

b) in subsection (3) (

a) by adding " if any, " after " lens, " and striking out " eye examination, and " and substituting " eye health examination; ",

(

c) in subsection (4) by striking out everything before paragraph (

a) and substituting the following:

(4) In a prescription for a corrective eyeglass lens provided under subsection (3), a registrant ,

(

d) in subsection (4) by striking out " and " at the end of paragraph (c) (ii), by adding " and " at the end of paragraph (

d) and by adding the following paragraph:

(

e) must set out the named individual's interpupillary distance, as measured at the time of the eye health examination. , and

(

e) by adding the following subsections:

(5) Subsection (4) (

e) does not apply to a registrant

(

a) who does not engage in the dispensing of corrective eyeglass lenses, and

(

b) whose practice of optometry is not associated or affiliated with another person who engages in the dispensing of corrective eyeglass lenses.

(6) A registrant must provide to an individual, free of charge and whether or not requested by the individual, a legible written or electronic copy of any prescription or contact lens record provided to the registrant by the individual for the purpose of dispensing a vision appliance.
