e) of the French version of the Pension Benefits Act,

chapter P-5.1 of the Acts of New Brunswick, 1987, is amended by striking out “conven ‐ tion fiduciaire” and substituting “convention de fidu ‐ cie”. 1(1) L’alinéa 9(1)

Section 12 of the Act is amended by adding after subsection (3) the following: 1(2) L’article 12 de la Loi est modifié par l’adjonc ‐ tion de ce qui suit après le paragraphe (3) : 12(4) Subsection (1) does not apply to 12(4) Le paragraphe (1) ne s’applique pas : (

a) a multi-employer pension plan established under a collective agreement or a trust agreement, or

a) aux régimes de pension interemployeurs établis au

b) a pension plan that contains a defined benefit provision if the obligation of the employer to contrib ‐ ute to the pension fund is limited to a fixed amount established in accordance with a collective agreement.

Section 34 of the Act is repealed and the follow ‐ ing is substituted: 1(3) L’article 34 de la Loi est abrogé et remplacé par ce qui suit : 1

34(1) In this section, “registered retirement savings ar ‐ rangement” means a registered retirement savings plan established in accordance with the Income Tax Act (Can‐ ada) or a registered retirement income fund established in accordance with that Act. 34(1) Dans le présent article, « arrangement enregistré d’épargne-retraite » s’entend d’un régime enregistré d’épargne-retraite constitué conformément à la Loi de l’impôt sur le revenu (Canada) ou d’un fonds enregistré de revenu de retraite constitué conformément à cette loi. 34(2) A pension plan may provide for payment to a former member of the commuted value of a benefit 34(2) Tout régime de pension peut prévoir le paiement de la valeur de rachat d’une prestation à un ancien parti ‐ cipant : (

b) if the commuted value of the benefit is less than 20% of the Year’s Maximum Pensionable Earnings for the calendar year in which the former member’s employment or membership in the pension plan, as the case may be, terminated.

Delivery under the Unclaimed Property Act Remise en vertu de la

(Director) 34.1(2) An administrator who holds unclaimed prop ‐ erty that is a commuted value referred to in subsection 34(2) or (3) is required to deliver it to the Director in ac ‐ cordance with the Unclaimed Property Act. 34.1(2) L’administrateur qui détient un bien non récla ‐ mé sous forme de valeur de rachat visée au paragra ‐ phe 34(2) ou (3) est tenu de le remettre au directeur conformément à la

Section 36 of the Act is amended 1(5) L’article 36 de la Loi est modifié (

a) in subsection (4) by striking out “notice of the rights” and substituting “the written statement refer ‐ red to in subsection 26(1)”;

b) by repealing subsection (8).

Section 35 of The Pooled Registered Pension Plans Act,

chapter 56 of the Acts of New Brunswick, 2017, is amended 3 L’article 35 de la

a) by repealing paragraph (1)(gg) and substitut ‐ ing the following:

a) par l’abrogation de l’alinéa (1)gg) et son rem ‐ placement par ce qui suit : (gg) respecting the withdrawal, in whole or in part, of the value of accumulated contributions of a retire ‐ ment savings arrangement, including providing for the circumstances in which such withdrawals may be made and prescribing the amounts of such withdraw ‐ als and the terms and conditions to which such with ‐ drawals may be subject; gg) prendre des mesures concernant le retrait, en tout ou en partie, de la valeur cumulative des cotisa ‐ tions versées au
