Section 15 of

An Act to Amend the Police Act,

chapter 21 of the Acts of New Brunswick, 2005, is amended 1 L’article 15 de Loi modifiant la

chapitre 21 des Lois du Nouveau-Brunswick de 2005 est modifié (

a) in

section 26.9 as enacted by

section 15

a) à l’article 26.9, tel qu’édicté par l’article 15, (

i) in subsection (1) by striking out “Notwith- standing” and substituting “Pending the outcome of proceedings taken under this Part and notwithstand- ing”; (

i) au paragraphe (1), par la suppression de « No- nobstant » et son remplacement par « En attendant les résultats des procédures engagées en application de la présente

partie et nonobstant »; (ii) in subsection (2) by striking out “during the period of suspension” and substituting “but for the suspension”; (ii) au paragraphe (2), par la suppression de « du- rant la période de suspension » et son remplace- ment par « n’eut été de la suspension »; (iii) by adding after subsection (2) the following: (iii) par l’adjonction, après le paragraphe (2), de ce qui suit : 26.9(3) After the conclusion of proceedings taken under this Part, the police officer shall receive all the pay, remu- neration, benefits and seniority to which the police officer would have been entitled but for the suspension less any pay, remuneration, benefits or seniority the police officer is not entitled to as a result of a disciplinary or corrective measure imposed by an arbitrator or agreed to by the par- ties to a settlement conference. 26.9(3) À l’issue des procédures engagées en applica- tion de la présente partie, l’agent de police doit recevoir la totalité du traitement et de la rémunération et bénéficier des avantages et de l’ancienneté auxquels il aurait eu droit n’eut été de la suspension, déduction faite du traitement et de la rémunération retenus, des avantages refusés et de l’ancienneté non reconnue en raison des mesures discipli- naires et correctives, soit imposées par un arbitre, soit sur lesquelles les parties se sont entendues dans le cadre d’une conférence de règlement. 1

26.9(4) Subsection (3) does not apply if the police offi- cer is dismissed. 26.9(4) Le paragraphe (3) ne s’applique pas dans le cas où l’agent de police est renvoyé. (
