OIC Text: The Governor in Council on the report and recommendation of the Minister of Economic and Rural Development and the Minister Responsible for Nova Scotia Business Inc. and the Minister of Natural Resources dated May 4, 2009, and pursuant to

Section 16 of

Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased, subject to: (

a) completion of the milestones and acceptance of the terms and conditions of the Agreement of Purchase and Sale dated April 15, 2009, which include the Province's right to re-acquire the lands should default occur; and (

b) the resolution of any existing encumbrances on the subject lands; to approve the issuance of a deed and/or grant by the Minister of Natural Resources to convey parcels of Crown land containing an area of approximately 177 hectares (437 acres), situate at Melford, in the Municipality of the District of Guysborough, and located within the areas coloured in red and green on the plan marked

Schedule "A" attached to and forming part of the report and recommendation, to Melford International Terminal Incorporated, a body corporate with its registered office at Halifax, Halifax Regional Municipality, its successors and assigns, for the consideration of the appraised market value as determined by an appraisal report completed by Ernest C. Smith, AACI, Accredited Appraiser, dated November 27, 2007, and to authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.
