Explanatory Note

Section 2, clause (

c) presently reads: "(c) "drug" means any substance, whether or not produced in whoQe or in part by synthetic process, and produced either alone or In conjunction with another -substance, the definition and compo sition of which Is found (

i) in the British Pharmacopoeia or other Pharmacopoeia ap proved by the Minister of Nationa~ He1l!lth for Oan1l!da, or (ii) in the Canadian Formulary or other Formulary approved and accepted by the Minister of National Health for Canada;". 3. Pharmacists permitted to dispense drugs generically equiv alent to those prescribed. 4. Commencement of Act.

BILL No. 107 of 1962

An Act to amend The Alberta Pharmaceutical Association Act (Assented to , 1962) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows: 1. The Alberta Pharmaceutical Association Act, being

chapter 232 of the Revised Statutes, is hereby amended.

Section 2, clause (

c) is amended (

a) by striking out the word "or" at the end of sub clause (

i) and by adding the word "or" at the end of subclause (ii), (

b) by adding immediately after subclause (ii) the following new subclause: (iii) in the Food and Drug Act (Canada) or the regulations thereunder; 3. The following new

section is added immediately after

section 44: 45. Where a prescription refers to a drug or medicine by a brand name or a name other than its generic or pharma cological name, a pharmaceutical chemist, in dispensing the prescription, may use a drug or medicine that is the generic or pharmacological equivalent of that named in the pre scription unless the prescriber indicates otherwise (

a) by designating the name of the manufacturer, or (

b) by specifying that no equivalent is to be dispensed. 4. This Act comes into force on the day upon which it is assented to.
