B.C. Reg. 77/2003, deposited March 14, 2003, pursuant to the COURT RULES ACT [Section 1]. Order in Council 212/2003, approved and ordered March 13, 2003.

On the recommendation of the undersigned, made after consultation with the Chief Justice of British Columbia, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Court of Appeal Rules, B.C. Reg. 297/2001, are amended as set out in the attached Schedule. — P. G. PLANT, Attorney General and Minister Responsible for Treaty Negotiations; G. CAMPBELL, Presiding Member of the Executive Council.

Schedule

1 Rule 9 of the Court of Appeal Rules, B.C. Reg. 297/2001, is amended by adding the following subrule:

(4) Unless a justice otherwise orders, the applicant in an application for a stay of proceedings or a stay of execution referred to in subrule (3) must serve the notice of motion and motion book referred to in subrule (3) (

c) at least 5 days before the date of the hearing of the application.

2 Rule 40 (3) (

a) is amended by striking out "4 copies" and substituting "3 copies".

3 Rule 47 (3) is amended by striking out "and" at the end of paragraph (b), by adding ", and" at the end of paragraph (

c) and by adding the following paragraph:

(

d) in the case of an order varying an order of a justice, be in Form 25.1.

4 Form 3 is amended by striking out "the order of ...............dated..............." and substituting "the order of ................................ of the ....................................................[ name of Court or Tribunal appealed from ] pronounced the ........... day of .............................., 20.....,".

5 Form 4 is amended, under the heading "COMPLETION INSTRUCTIONS" , by adding "an index and" before "the following".

Section 3 of Form 7 is amended

(

a) by striking out "[ ] Family -" and substituting "Family -", and

(

b) by adding "[ ] Other Family" after "[ ] Corollary Relief in a Divorce Proceeding".

7 Form 8 is amended

(

a) by striking out "To the respondent(s):" and substituting "To the appellant(

s) and any respondent(

s) not bringing a cross appeal:", and

(

b) by striking out "And to its solicitor:" and substituting "And to their solicitor(s):".

8 Form 14 is amended by striking out everything after "The estimates of each are as follows:" and substituting the following:
