Licences
1(1) The Minister may issue the following classes of licence:
(
a) investigator licence;
(
b) security services licence;
(
c) locksmith licence;
(
d) training licence.
(2) The Minister may issue an individual licence to an individual
worker and a business licence to a security services business for each
class of licence listed in subsection (1).
Security services licence
2 The following types of security services licence may be issued:
(
a) general security services licence;
(
b) loss prevention licence;
(
c) executive security licence;
(
d) patrol dog handler licence;
(
e) patrol dog services business licence;
(
f) security alarm responder licence.
Locksmith licence
3 The following types of locksmith licence may be issued:
(
a) general locksmith licence;
(
b) locksmith equipment sales and promotion licence;
(
c) automotive lock bypass worker licence.
Training licence
4 The following types of training licence may be issued:
(
a) general training licence;
(
b) locksmith apprentice training licence.
Application for or renewal of individual licence
5 An application for or a renewal of an individual licence must be
accompanied by
(
a) a statement signed by the applicant showing what, if any,
criminal charges, convictions or investigations there are
against the applicant,
(
b) proof that the applicant has reached the age of majority,
(
c) a colour passport-sized photograph of the applicant taken
within the previous 3 months and notarized by a person
authorized by the Registrar,
(
d) proof that the applicant is a Canadian citizen or lawfully
entitled to work in Canada,
(
e) a criminal record check, police information check and
vulnerable sector search,
while carrying out his or her duties,
(
g) if required for the purposes of the class of licence, proof that
the applicant has successfully completed training
requirements, including baton training, as approved by the
Registrar, and
(
h) any other information requested by the Registrar.
Application for or renewal of business licence
6(1) Subject to subsection (2), an application for or a renewal of a
business licence must be accompanied by
(
a) proof that the business is incorporated in Canada and has a
mailing address in Alberta,
(
b) proof the business has minimum liability insurance of
$1 000 000,
(
c) if required, a municipal business licence or permit,
(
d) a description of the security services the business plans to
provide,
(
e) colour pictures of uniforms,
(
f) colour pictures of vehicles,
(
g) samples of the shoulder crest on uniforms, if applicable,
(
h) a copy of the internal policy of the business for training,
issuing, using and storing weapons and equipment, if
applicable,
(
i) a list of equipment carried and used by individual licensees,
(
j) the complaint management process,
(
k) contact information for senior officials for the business,
(
l) a list of individual licensees that are employed by the
business and a list of individuals who, subject to being issued
a licence, will be employed by that business,
(
m) a criminal record check, police information check or
vulnerable sector search for each director and officer of the
business,
(
n) a signed statement for each owner and partner of the business
showing what, if any, convictions there are against that
individual, and
(
o) any other information requested by the Registrar.
(2) Where the security services provided by a business are not the
primary services provided by a business, that business is not required
to submit the information referred to in subsection (1)(
m) and (
n) with
the application for or a renewal of a business licence.
Locksmith licence
7(1) In addition to the requirements under
section 351 of the Criminal
Code (Canada), 12 months after the date on which the Act comes into
force, an applicant for a locksmith licence must provide the Registrar
with a copy of the individual's trade certificate or an approved
equivalency.
(2) If an individual who holds a locksmith licence applies for an
individual licence in another class of licence, the individual must
obtain the Registrar's prior approval.
locksmith licensee may perform all of the functions performed by an
automotive lock bypass worker licensee.
(4) An investigator may not hold a locksmith licence or an automotive
lock bypass worker licence.
Issue of licence
8 The Registrar may issue a licence subject to any terms and
conditions the Registrar considers appropriate.
Term of licence
9(1) A business licence may be issued for a term of up to 3 years.
(2) Subject to subsection (3), an individual licence may be issued for a
term of up to 2 years.
(3) If an individual has a valid Canada work permit, the term of the
individual licence expires at the same time the Canada work permit
expires.
10(1) The Registrar may, at any time, cancel, suspend or impose any
considers appropriate.
(2) If the Registrar cancels, suspends or imposes additional terms and
conditions on a licence under subsection (1), the Registrar must
provide written notice to the licensee, and if the licensee is an
individual licensee, provide written notice to the business licensee that
employs or engages the services of that individual licensee.
Restriction on individual licences
11(1) An individual licence is only valid while the individual licensee
is employed or engaged for services by a business licensee.
(2) An individual licensee may not act as or hold out to be a business
that can provide, perform or sell security or investigative work.
Portability of individual licences
12(1) A business licensee must notify the Registrar
(
a) when the business licensee employs an individual licensee,
and
(
b) when that individual licensee is no longer employed by the
business licensee.
(2) An individual licensee may be employed by more than one
business licensee, simultaneously or consecutively, during the term of
the individual licence.
Failure to renew individual licence
13 If an individual licensee fails to renew his or her licence, the
Registrar must notify the business licensee that employs or engages the
services of the individual licensee of the individual licensee's failure to
renew the licence.
Training
14(1) An applicant for an individual licence must
(
a) complete the applicable training program established by the
Registrar for the class of individual licence applied for, and
(
b) pass the training test established by the Registrar with a grade
satisfactory to the Registrar.
(2) The Registrar may certify a person or business to deliver training
programs for a particular class of individual licence.
(3) Applicants who require baton training must successfully complete
a 40-hour use-of-force training course approved by the Registrar every
36 months.
(4) Subsections (1) and (2) apply to applicants for a security services
licence or applicants for a locksmith licence 12 months after the date
on which the Act comes into force.
(5) Subsections (1) and (2) apply to applicants for an investigator
licence 24 months after the date on which the Act comes into force.
Training licences
15(1) If an individual is in the process of completing training required
in order to obtain an individual licence of a particular class of licence,
the business licensee that employs that individual must apply to the
Registrar for a training licence on behalf of that individual.
(2) The Registrar may issue
(
a) a general training licence in accordance with
section 4, or
(
b) a locksmith apprentice training licence in accordance with
section 4.
(3) Any change in information to the application submitted under
subsection (1) must be provided by the business licensee to the
Registrar within 30 days.
General training licence
16(1) A general training licence may only be issued to an individual
once and may not be renewed.
(2) A general training licence may be issued for a term of up to 30
days.
(3) An individual who holds a general training licence must be
supervised by an individual licensee who currently holds and has held
a valid licence in the same class of licence for a minimum of 2 years.
(4) While on duty, a general training licensee
(
a) must be in uniform, if required for that particular class of
licence,
(
b) may not carry handcuffs or a baton, and
(
c) may not drive a vehicle.
(5) At any time during the training period, a general training licensee
must pass a written examination.
(6) If an individual does not pass the written examination with a grade
satisfactory to the Registrar during the term of the general training
licence, the individual may re-write the examination at any time within
2 years from the date the general training licence was issued but the
individual may not perform any of the functions performed by a
licensee.
(7) On passing the written examination with a grade satisfactory to the
Registrar, a general training licensee must return the general training
licence to the Registrar prior to the Registrar issuing a valid licence for
a specific class of licences.
Locksmith apprentice training licence
17(1) The minimum age for a locksmith apprentice is 16 years.
(2) A locksmith apprentice training licence may be issued for a term
of up to 7 years.
(3) An apprentice locksmith must provide the Registrar and the
business licensee employer with proof of enrolment in an
apprenticeship program approved by the Registrar.
(4) An apprentice locksmith may carry lock picks and any other trade
tools identified under
section 351 of the Criminal Code (Canada).
Security alarm responder business licensees
18(1) A security alarm responder business licensee must ensure all
employees who have access to clients' personal information undergo a
police information check and a criminal records check every 3 years.
(2) The results of the police information check and criminal records
check referred to in subsection (1) must be kept on file for a minimum
of 3 years and be provided to the Registrar on request.
(3) A security alarm responder business licensee must ensure the
business implements effective and safe storage of the business's
clients' personal information and must provide a copy of the business's
storage protocols to the Registrar with the application for or renewal of
a security alarm responder business licence.
Exemption from licensing
19(1) The owner, manager or designate of an owner or manager of a
business that attends the premises where a security alarm has been
triggered at the request of a security alarm responder or security
services business to meet the police, the security services business
representative or an alarm responder for the purpose of providing
access to, information about or the verification of the validity of an
alarm is not required to hold a licence.
(2) Any individual licensee, other than a locksmith licensee, who has
been hired to provide security or investigative services to a business
and who responds to a security alarm does not need a security alarm
responder licence.
Code of conduct
20(1) Every business licensee must establish and maintain a code of
conduct for individual licensees it employs or engages the services of.
(2) The code of conduct must include provisions applicable to the
duties and responsibilities of individual licensees the business licensee
employs or engages the services of, including
(
a) requiring individual licensees to act with honesty and
integrity,
(
b) requiring individual licensees to comply with all federal,
provincial and municipal laws,
(
c) requiring individual licensees to respect and use all property
of the individual licensee's licence,
(
d) requiring individual licensees to comply with the terms and
conditions of the individual's licence,
(
e) requiring individual licensees to comply with the business
licensee's code of conduct for individual licensees,
(
f) prohibiting individual licensees from engaging in disorderly
or inappropriate conduct,
(
g) prohibiting individual licensees from withholding or
suppressing information, complaints or reports about any
other licensee,
(
h) prohibiting individual licensees from making or signing false,
misleading or inaccurate statements,
(
i) respecting when confidentiality must be maintained,
(
j) prohibiting individual licensees from consuming alcohol
while on duty, except in the performance of the individual
licensee's duties,
(
k) prohibiting individual licensees from consuming controlled
drugs and controlled substances under the Controlled Drugs
and Substances Act (Canada), and
(
l) except in the performance of the individual licensee's duties,
prohibiting individual licensees from possessing or
consuming alcohol.
Uniforms
21(1) Unless exempted by
section 22 or the Registrar, an individual
licensee must wear an approved uniform while on duty.
(2) An individual licensee must not, while engaged in security or
investigative services, wear a uniform that resembles a uniform used
by police officers or other law enforcement agencies.
(3) A uniform
(
a) may be any colour,
(
b) may show rank markings on part of the uniform as
determined by the business licensee,
(
c) may only have a white reflective stripe on a pant or hat band,
(
d) for security services workers, must have the term
"SECURITY", "SECURITY GUARD" or "SECURITY
AGENT" clearly displayed on the front, back and both
shoulders of all shirts, sweaters, vests, coveralls and jackets
with lettering
(
i) that is a colour that contrasts with the colour of the
uniform,
(ii) on the front and both shoulders of the uniform that is in
upper case and not less than 1.5 centimetres high, and
(iii) on the back of the uniform that is in upper case and not
less than 5 centimetres high,
and
(
e) for security service workers, must bear a shoulder flash on
the upper sleeve of all shirts, sweaters, coveralls and jackets
that clearly displays the name of the business licensee and the
shoulder flashes must not resemble a shoulder flash used by a
police agency or a peace officer agency.
(4) Individual licensees whose uniforms are a suit or include a blazer
must wear an identification tag on the suit or blazer lapel that clearly
displays the term "SECURITY", "SECURITY GUARD" or
"SECURITY AGENT" and the name of business licensee.
(5) This
section comes into force 12 months after the coming into
force of the Act.
Exemption from uniforms
22(1) The following classes of licences are exempt from the uniform
requirements listed under
section 21:
(
a) executive security workers;
(
b) loss prevention workers;
(
c) investigators;
(
d) locksmiths and locksmith apprentices;
(
e) automotive lock bypass workers.
(2) If an executive security worker or a loss prevention worker is
required by the licensee's employer to wear a uniform, the uniform
must comply with the requirements listed under
section 21.
(3) A business licensee may submit a request in writing to the
Registrar for an exemption from the uniform requirements for its
individual licensees for specific events or contracts.
Badges
23(1) An individual licensee may only use a badge in the course of
providing security services if it is issued by the business licensee that
employs or engages the services of the individual licensee.
(2) A badge issued under this Regulation must meet the standards
established by the Registrar.
(3) A badge may not form part of or be attached to any part of an
individual licensee's uniform.
(4) A badge must be returned to the business licensee when the
individual licensee is no longer employed by the business licensee.
(5) A badge must not be used in place of a licence identification card
and must only be shown with a licence identification card.
Licence identification card
24(1) The Registrar shall issue a licence identification card to each
individual licensee that includes the following information:
(
a) a picture of the individual licensee;
(
b) the name of the individual licensee;
(
c) the licence number;
(
d) the authorized class or classes of licence;
(
e) the expiry date of the licence;
licence identification card.
(2) An individual licensee must carry the licence identification card
issued under subsection (1) while on duty, and must present it to any
person on request.
(3) If an individual licensee loses the individual licensee's licence
identification card, the loss must be reported to the Registrar within 24
hours.
Vehicles
25(1) A vehicle used for security services may be any colour
acceptable to the Registrar.
(2) Vehicle marking must
(
a) include the term "SECURITY", "SECURITY SERVICES"
or " SECURITY AGENT" in upper-case letters that are
(
i) not less than 10 centimetres high on each side of the
vehicle, and
(ii) not less than 8 centimetres high on the front and back of
the vehicle,
(
b) be displayed clearly in a contrasting colour on the front, back
and each side of the vehicle,
(
c) display the name of the business licensee,
(
d) display the crest or logo of the business licensee, if any, and
(
e) may include colour stripes so long as the colour stripes do
not resemble the colour stripes or colour combination used
by the RCMP, a police agency or a peace officer agency.
(3) Locksmith licensees, automotive lock bypass worker licensees,
investigator licensees, loss prevention worker licensees and executive
security service licensees are not required to mark the vehicles used in
the performance of security or investigative services.
(4) Flashing lights, other than turn signals and hazard warning lamps,
may be affixed to a vehicle with the prior approval of the Minister
responsible for the Traffic Safety Act.
(5) An individual licensee must provide a copy of the approval
obtained under subsection (4) to the Registrar.
(6) Subsections (1), (2) and (3) come into force 24 months after the
coming into force of the Act.
Acknowledgement of complaints
26 On receipt of a complaint under
section 24 of the Act, the
business licensee must acknowledge to the complainant receipt of the
complaint in writing within 30 days and, where the Registrar deems
appropriate, notify the individual licensee concerned that a complaint
has been made and advise the complainant of the status of the
complaint in accordance with
section 25 of the Act.
Investigation of complaints
27(1) If an investigation is carried out in respect of a complaint under
section 24 of the Act, the business licensee must, where the Registrar
deems appropriate, give the individual licensee notice of the details of
the complaint.
(2) The investigation must be carried out in accordance with the
business licensee's policies and procedures provided to the Registrar
under
section 6.
Disposition of complaints
28(1) Subject to
section 25 of the Act, the authorized employer must
dispose of a complaint by making one of the following decisions and
giving reasons for the decision:
(
a) the complaint is unfounded;
(
b) the complaint is unsubstantiated;
(
c) the complaint is found to have merit in whole or in part;
(
d) the complaint is frivolous, vexatious or made in bad faith.
(2) If a complaint about an individual licensee is found to have merit
or is founded in part, the business licensee must notify the
complainant, the individual licensee concerned and the Registrar of the
disposition.
(3) If a complaint about an individual licensee is disposed of under
section 25(3) of the Act, the employer must notify the complainant in
writing of the right of the complainant to have the employer's
disposition of the complaint reviewed by the Registrar.
Prohibitions
29(1) The following persons are prohibited from holding a licence
under this Regulation:
(
a) a police officer as defined in the Police Act;
(
b) a sheriff as defined in the Civil Enforcement Act;
(
c) a bailiff as defined in the Civil Enforcement Act;
(
d) a collection agency or a collector as defined in the Fair
Trading Act.
(2) A peace officer as defined in the Peace Officer Act may also hold
an individual licence under this Regulation.
Offences
30 A person who contravenes or fails to comply with any of the
following provisions is guilty of an offence:
section 14(3);
section 16(4);
section 18(1), (2) or (3);
section 21(1), (2), (3) or (4);
section 23(1), (2), (3), (4) or (5);
section 24(2) or (3);
section 25(1), (2), (3), (4) or (5);
section 26
section 27(1) or (2);
section 28(2) or (3).
Transitional
31(1) The Registrar shall renew an investigator licence if the licensee
demonstrates to the satisfaction of the Registrar that the licensee
(
a) has a minimum of 2 years of full-time experience as an
investigator,
(
b) has a minimum of 4 years of part-time experience as an
investigator,
(
c) has a minimum of 2 years of experience with a police
service, or
(
d) has any other type of experience acceptable to the Registrar.
(2) Subsection (1) no longer applies to the renewal of an investigator
licence 24 months after the date on which the Act comes into force.
Expiry
32 For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be
repassed in its present or an amended form following a review, this
Regulation expires on March 31, 2015.
Coming into force
33 This Regulation comes into force on the coming into force of the
Security Services and Investigators Act.

The fee prescribed in Column 2 for a one-year licence term or Column
3 for a 3-year licence term, as the case may be, must be paid for the
business licence application described in Column 1.

4 The term of a Senate nominee declared elected in the election
held in 2004 under the Senatorial Selection Act expires on the earlier

a) the issuance of a writ under
section 5(1)(
b) of the Senatorial
Selection Act, or
(
b) December 2,

Definitions
1 In this Regulation,
(a) "Act" means the Municipal Government Act;
(b) "assessment baseline" means the property assessment of each
property within the Belvedere Community Revitalization
Levy Area as of December 31 of the year in which the
community revitalization levy bylaw is approved by the
Lieutenant Governor in Council;
(c) "Belvedere Community Revitalization Levy Area" means the
City of Edmonton community revitalization levy area
established pursuant to
section 3;
(d) "community revitalization levy bylaw" means a bylaw
passed by the council to impose a levy in respect of the
incremental assessed value of property in the Belvedere
Community Revitalization Levy Area;
(e) "community revitalization levy rate" means the rate imposed
under a community revitalization levy bylaw for the
applicable assessment class or sub-class of property;
(f) "council" means the council of the City of Edmonton;
(g) "incremental assessed value" has the meaning given to it in
section 381.1(
a) of the Act;
(h) "property" has the meaning given to it in
section 284(1)(
r) of
the Act.
Scope of Regulation
2(1) This Regulation applies only to property located in the Belvedere
Community Revitalization Levy Area.
(2) Sections 6 to 14 apply only if
(
a) the council passes a community revitalization levy bylaw in
respect of the Belvedere Community Revitalization Levy
Area, and
(
b) the Lieutenant Governor in Council approves the community
revitalization levy bylaw.
Establishment of community revitalization levy area
3 This Regulation establishes a community revitalization levy area in
the City of Edmonton, known as the Belvedere Community
Revitalization Levy Area, on the lands described in the Schedule.
Community revitalization plan
4(1) Before passing a community revitalization levy bylaw in respect
of the Belvedere Community Revitalization Levy Area, the council
must
(
a) prepare a community revitalization plan for the Belvedere
Community Revitalization Levy Area,
(
b) hold one or more public hearings on the proposed community
revitalization plan in accordance with
section 606 of the Act,
and
(
c) make and keep a record of any public hearings, and make the
results of the public hearings available to the public.
(2) A community revitalization plan must address
(
a) the objectives, risks and benefits associated with the plan,
(
b) the need for the plan, including substantiation that
redevelopment will not progress significantly in its absence,
(
c) the costs associated with the plan, including the amount and
timing of projected
(
i) redevelopment capital costs,
(ii) borrowing costs, and
(iii) other costs,
(
d) the revenues associated with the plan, including the amount
and timing of projected
(
i) community revitalization levies in respect of the
incremental assessed value of property in the Belvedere
Community Revitalization Levy Area,
(ii) general municipal revenues, and
(iii) other revenue sources,
(
e) the amount, timing and source of projected borrowings
associated with the plan, and the amount and timing of the
repayments,
(
f) a low, medium and high projection of estimated changes in
the incremental assessed value of property in the Belvedere
Community Revitalization Levy Area and the consequent
impact on projected revenues from community revitalization
levies,
(
g) how the municipality will fund any shortfall in the event that
actual revenues associated with the plan are not sufficient to
provide for the actual costs and repayment of borrowings
associated with the plan,
(
h) the proposed land uses for the Belvedere Community
Revitalization Levy Area,
(
i) the proposed phasing of development in the Belvedere
Community Revitalization Levy Area,
(
j) the impact, if any, that the redevelopment of the Belvedere
Community Revitalization Levy Area will have on the
residents of that area,
(
k) which features, facilities and characteristics of the
municipality will be adversely affected by the redevelopment
of the Belvedere Community Revitalization Levy Area and
what is proposed to mitigate those effects,
(
l) which historically significant buildings in the Belvedere
Community Revitalization Levy Area will be conserved and
maintained and how they will be conserved and maintained,
and
(
m) the expected role of private sector developers in the
redevelopment of the Belvedere Community Revitalization
Levy Area.
(3) A community revitalization plan must be consistent with the land
use policies established by the Lieutenant Governor in Council under
section 622 of the Act.
Community revitalization levy bylaw
5(1) A community revitalization levy bylaw must include all of the
information required to be included in the community revitalization
plan.
(2) A community revitalization levy bylaw may be amended by the
council, but the amendment has no effect unless it is approved by the
Lieutenant Governor in Council.
Borrowing bylaw
6 Despite sections 256 to 263 of the Act, a borrowing bylaw for the
purpose of implementing the community revitalization plan, in whole
or in part, must be advertised in accordance with
section 606 of the
Act.
Preparation of assessments
7 Assessments of property in the Belvedere Community
Revitalization Levy Area must be prepared in the same manner as
similar properties in the municipality in accordance with
Part 9 of the
Act, as modified by this Regulation.
Community revitalization assessment roll
8(1) The municipality must prepare annually, not later than February
28, a community revitalization assessment roll.
(2) A community revitalization assessment roll may be a continuation
of the assessment roll prepared under
Part 9 of the Act or may be
separate from that roll.
Community revitalization levy roll
9(1) The municipality must prepare a community revitalization levy
roll annually.
(2) A community revitalization levy roll may be a continuation of the
tax roll prepared under
Part 10 of the Act or may be separate from that
roll.
(3) A community revitalization levy roll must show the same
information that is required to be shown on the tax roll in accordance
with
section 329 of the Act.
Community revitalization levy rate bylaw
10(1) The council must pass a community revitalization levy rate
bylaw annually.
(2) A community revitalization levy rate bylaw must
(
a) set and show separately all of the community revitalization
levy rates that must be imposed to raise the revenue required
to meet the levy increment financing program and council's
approved budget, and
(
b) not be imposed in respect of property that
(
i) is exempt under
section 351, 361 or 362 of the Act, or
(ii) is exempt under
section 363 or 364 of the Act, unless
the bylaw passed under
section 363 makes the property
taxable.
(3) A community revitalization levy rate must be equal to or greater
than the tax rates established annually for the corresponding property
tax bylaw for each assessment class or sub-class of property referred to
section 297 of the Act.
(4) A community revitalization levy rate bylaw may set out the class
and subclass tax rates for the municipal property tax, the school
requisition and the community revitalization levy rate.
Calculating the amount of the levy
11(1) The amount of the levy to be imposed in respect of property
located in the Belvedere Community Revitalization Levy Area is to be
calculated by multiplying the incremental assessed value for the
property by the community revitalization levy rate to be imposed on
that property.
(2) If a tax-exempt property in the Belvedere Community
Revitalization Levy Area becomes taxable or partially taxable, the
community revitalization levy for that property is to be calculated on a
prorated basis by applying the community revitalization levy rate to
the incremental assessed value of the taxable portion of the property.
(3) The community revitalization levy under subsection (2) is to be
applied beginning in the year that the property becomes taxable or
partially taxable.
(4) If a tax-exempt property in the Belvedere Community
Revitalization Levy Area becomes taxable or partially taxable, the
assessment baseline for that property shall be excluded from the
equalized assessment beginning in the year that the property becomes
taxable or partially taxable.
(5) If taxable property in the Belvedere Community Revitalization
Levy Area becomes tax exempt, no community revitalization levy is to
be applied to that property beginning in the year that the property
becomes exempt.
(6) If, after the community revitalization area has been established,
there is
(
a) a subdivision affecting the property within the Belvedere
Community Revitalization Levy Area, or
(
b) a consolidation of 2 or more properties within the Belvedere
Community Revitalization Levy Area,
in respect of which a community revitalization levy is payable, the
municipality must reallocate the assessment baseline to each of the
new properties in the year that the subdivision or consolidation occurs.
(7) If, after the community revitalization area has been established,
there are changes to the assessment class or assessment sub-class for a
property, the municipality may revise the assessment class or sub-class
applicable to the property assessment baseline to reflect those changes
with respect to future years.
Separate fund required
12 A community revitalization levy collected from the Belvedere
Community Revitalization Levy Area, and any interest earned from the
investment of that levy, must
(
a) be accounted for separately from other levies collected, and
(
b) be used only for the purposes specified for the Belvedere
Community Revitalization Levy Area.
Application of Parts 9 to 12 of Act
13 Except as modified by this Regulation, Parts 9 to 12 of the Act
relating to the assessment and taxation of property apply, with the
necessary modifications to a community revitalization levy, and for
that purpose a reference in those Parts to
(
a) a tax imposed under
Part 10, Division 2 is deemed to be a
reference to a community revitalization levy,
(
b) a property tax bylaw is deemed to be a reference to a
community revitalization levy bylaw,
(
c) an assessment roll is deemed to be a reference to a
community revitalization assessment roll, and
(
d) a tax roll is deemed to be a reference to a community
revitalization levy roll.
Termination of a community revitalization levy bylaw
14 The community revitalization levy bylaw is terminated on the
earliest of the following:
(
a) at the end of a period of 20 years from the year in which the
community revitalization levy bylaw is approved by the
Lieutenant Governor in Council;
(
b) the date that all borrowings for the Belvedere Community
Revitalization Levy Area are repaid or recovered from the
revenues associated with the community revitalization plan;
(
c) an earlier date specified by the Lieutenant Governor in
Council.
Expiry
15 For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be
repassed in its present or an amended form following a review, this
Regulation expires on December 31, 2020.

Establishment
1 A regional services commission known as the Beaver Emergency
Services Commission is established.
Members
2 The following municipalities are members of the Commission:
(
a) Beaver County;
(
b) Town of Viking;
(
c) Town of Tofield;
(
d) Village of Ryley;
(
e) Village of Holden.
Services
3 The Commission is authorized
(
a) to provide fire services, and
(
b) to carry out the powers and duties of the member
municipalities under the Emergency Management Act.
Operating deficits
4 The Commission may not assume operating deficits that are shown
on the books of any of the member municipalities.
Property
5(1) The member municipalities shall execute all documents and do
all things necessary to transfer to the Commission all land, buildings
and personal property listed in the Schedule.
(2) The Commission may not, without the approval of the Lieutenant
Governor in Council, sell any of its land, buildings or personal
property whose purchase has been funded wholly or partly by grants
from the Government of Alberta.
(3) The Lieutenant Governor in Council may give approval under
subsection (2) if satisfied
(
a) as to the repayment of grants from the Government of
Alberta and outstanding debt associated with that portion of
the land, buildings and personal property to be sold,
(
b) that the sale would not have a significant adverse effect on
the services the Commission provides, and
(
c) that the sale will be properly reflected in the rates
subsequently charged to the member municipalities of the
Commission.
Non-profit corporation
6(1) The Commission is to operate as a non-profit corporation unless
otherwise approved by the Minister.
(2) The Minister's approval may contain any terms or conditions that
the Minister considers appropriate.

Corrections Act
CORRECTIONAL INSTITUTION AMENDMENT REGULATION

1 The Correctional Institution Regulation (AR 205/2001) is
amended by this Regulation.
Section 1 is amended
(
a) in subsection (1)
(
i) in clause (
a) by striking out "under" and
substituting "in";
(ii) by adding the following after clause (d):
(e) "privileged communication" means a
communication between an inmate and any of the
following persons, offices or entities:
(
i) the inmate's legal counsel;
(ii) the Executive Director or any delegate of the
Executive Director;
(iii) the Chief Executive Officer of the Alberta
Correctional Services or any delegate of the
Chief Executive Officer;
(iv) the Commissioner of Corrections or the
Correctional Investigator appointed under the
Corrections and Conditional Release Act
(Canada);
(
v) a member of the Senate or House of
Commons of Canada;
(vi) a member of the legislative assembly of
Alberta or of another province or territory of
Canada;
(vii) the Information and Privacy Commissioner
appointed under the Freedom of Information
and Protection of Privacy Act or the Privacy
Commissioner appointed under the Privacy
Act (Canada);
(viii) the Alberta Human Rights Commission or the
Canadian Human Rights Commission;
(ix) the Auditor General of Alberta or of Canada;
(
x) a person designated as an officer under the
Immigration and Refugee Protection Act
(Canada), if the inmate is detained or subject
to a warrant for arrest and detention under
that Act;
(xi) an ombudsman appointed under
an Act of
Alberta;
(xii) a tipline program operated by a crime
stoppers association, a law enforcement
agency, a correctional institution or any
similar entity to receive information on a
confidential basis respecting offences.
(
b) by adding the following after subsection (2):
(3) In
section 1(d.1) of the Act, "privileged communication" has
the meaning specified in subsection (1)(e).
3 Sections 31 and 31.1 are repealed and the following is
substituted:
Inmate communication systems
31(1) In this section, "inmate communication" includes a privileged
communication.
(2) The Chief Executive Officer may authorize the establishment of
inmate communication systems in an institution for the purposes of
(
a) providing inmates with reasonable access to communication
systems, and
(
b) ensuring the security of the institution and the protection of
the public.
(3) The Director may suspend inmate access to any inmate
communication system if, in the Director's opinion,
(
a) the system is being misused or abused, or
(
b) the suspension is necessary to maintain the security of the
institution.
Identifiers of institution
31.1 The Director of an institution shall, if directed to do so by the
Chief Executive Officer, ensure that
(
a) the name of the institution is attached to inmate
communications that are directed to recipients outside of the
institution, and
(
b) a recorded announcement, identifying that the inmate
communication comes from the institution, is played at the
beginning of inmate communications that are made by
telephone or other electronic means to a place outside of the
institution.
Privileged communications
31.2(1) Privileged communications must not be recorded or
monitored.
(2) If a privileged communication is inadvertently recorded during
repair and maintenance of a communication system or otherwise,
(
a) the communication must not be monitored, and
(
b) the record of the communication must be destroyed as soon
as practicable after any employee or agent of the institution is
notified or becomes aware that the communication was
recorded.
Notice of recording
31.3(1) In this section, "writing" includes e-mail and other
electronic writing, and "written" has a corresponding meaning.
(2) Before recording an inmate communication, the Director must
give reasonable notice to the inmate that the communication may be
recorded.
(3) Notice may be given under subsection (2) by means of
(
a) a written message on, attached to or accompanying any
inmate communication that is made in writing,
(
b) a recorded announcement played at the beginning of any
inmate communication that is made by telephone or any
other electronic means that includes an audio transmission, or
(
c) any other method by which the notice may reasonably be
expected to come to the inmate's attention before recording
begins.
Retention of records
31.4 If a record of an inmate communication contains some or all
of the words that were communicated or any images of the parties to
the inmate communication, the record must not be retained for
longer than 90 days unless there are reasonable grounds to believe
that the inmate is
(
a) involved in illegal activities,
(
b) harassing or causing harm to others, or
(
c) participating in an activity that may jeopardize the
management, operation or security of the institution.
Monitoring
31.5 An inmate communication must not be monitored except
(
a) in circumstances where the monitoring is authorized under
section 14.4(2) of the Act, and
(
b) where the inmate has first been given reasonable notice that
the inmate communication may be monitored.
Authorized means of monitoring
31.6(1) Where monitoring of an inmate communication is
authorized under
section 14.4(2) of the Act, the communication may
be monitored by listening to, watching or reading it or any record of
it that is made in accordance with the Act and this Regulation.
(2) Monitoring under subsection (1) may be carried out by
electronic or other means.
4 The following is added after
section 42:
Part 2.1
Earned Remission
Remission and crediting of remission
42.1(1) Subject to subsections (3) and (4) and
section 46(e), every
inmate who is serving a sentence for an offence under a provincial
enactment or a municipal bylaw shall be credited with remission of
the sentence, in an amount not exceeding 15 days for each 30 days
served during which the inmate earns that remission.
(2) The criteria for earning remission are
(
a) obeying all rules of the institution,
(
b) actively participating in any work training or treatment
programs assigned under
section 11 of the Act,
(
c) actively participating in any employment program required
under
section 17 of the Act, and
(
d) complying with the conditions of any temporary absence
authorized under
section 23 of the Act.
(3) If an inmate, on one or more occasions,
(
a) violates a rule referred to in subsection (2)(a),
(
b) fails to actively participate in a program referred to in
subsection (2)(
b) or (c), or
(
c) fails to comply with a condition referred to in subsection
(2)(d),
the inmate may, in accordance with policy and procedures approved by
the Director, be found not to have met the criteria for earning some or
all of the remission that the inmate could have earned under subsection
(2).
(4) No remission is earned under this
section in respect of a sentence
(
a) on conviction for criminal or civil contempt of court where
the sentence includes a requirement that the inmate return to
that court, or
(
b) to which
section 6 of the Prisons and Reformatories Act
(Canada) applies.
(5) Where remission is credited under this
section against a sentence
being served by an inmate, the inmate is entitled to be released from
imprisonment before the expiration of the sentence.
(6) As soon as is reasonably possible after an inmate begins serving a
sentence in respect of which remission may be credited under this
section, the inmate must be advised of the earliest possible date on
which the inmate could, if the inmate earns all possible remission and
does not forfeit any remission, be released under subsection (5).
(7) As soon as is reasonably possible after
(
a) an inmate is found not to have met the criteria for earning
some or all of the remission that the inmate could have
earned under subsection (2), or
(
b) a forfeiture of remission is imposed under
section 46(e),
the inmate must be informed of the amount of remission the inmate
failed to earn or forfeited, the reasons for the failure or forfeiture and
the resulting revision of the inmate's earliest possible release date.
(8) Where an inmate is reincarcerated following the suspension of
parole and the parole is subsequently revoked, the inmate shall be
credited with remission in respect of the portion of the sentence that
was served during the suspension.
(9) For the purposes of applying this section,
(
a) where a sentence is expressed as a period of months or years
rather than days, the sentence is to be converted to a number
of days, and
(
b) where the number of days to be served for a sentence is a
number that is not evenly divisible by 3, the number is to be
rounded down to the nearest number that is evenly divisible
by 3 and no remission is to be credited for the extra day or
days.
Section 48.2(3), (4) and (5) are amended by striking out
"director or the director's delegate" wherever it occurs and
substituting "Director or the Director's delegate".
6 This Regulation comes into force on the coming into
force of the Corrections Amendment Act, 2009.

Carbon Capture and Storage Funding Act
CARBON CAPTURE AND STORAGE FUNDING REGULATION

Definitions
1 In this Regulation,
(a) "Act" means the Carbon Capture and Storage Funding Act;
(b) "advisory committee" means a committee established by the
Minister under
section 7 of the Government Organization Act
to advance the purposes of the Act;
(c) "Minister" means the Minister of Energy.
Authority to make payments
2 The Minister may make payments under the Act for any of the
following if, in the opinion of the Minister, the payment will advance
the purpose of the Act:
(
a) payments for the expenses of the Minister's Department
incurred to develop or refine a regulatory system for carbon
capture and storage projects in Alberta, including payments
for remuneration of and expenses incurred by members of
advisory committees;
(
b) payments for the expenses of the Minister's Department
incurred with respect to further education regarding carbon
capture and storage projects;
(
c) payments to any person or organization to acquire
information, studies or research findings or to otherwise
obtain knowledge where it can reasonably be expected to
benefit carbon capture and storage projects in Alberta.
Expiry
3 For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be
repassed in its present or an amended form following a review, this
Regulation expires on April 30, 2015.
