On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that the Administration Delegation

Regulation, B.C. Reg. 154/2004, is amended as set out in the attached Schedule.

Schedule

Section 1 of the Administration Delegation Regulation, B.C. Reg. 154/2004, is

repealed and the following substituted:

Delegation to British Columbia Safety Authority

(1) For the purposes of sections 2 and 6 of the Railway Safety Act , the administration of the Railway Safety Act is delegated to the British Columbia Safety Authority, except for

(

a) sections 3, 11, 12 and 20 and Parts 4 and 5, and

(b)

section 19 (0.1) of the Canadian Transportation Accident Investigation and Safety Board Act , adopted by

section 5 of the adopting regulation.

(2) Despite subsection (1), the administration of provisions that is otherwise

delegated by this regulation is not delegated to the British Columbia Safety Authority.

Section 2 (2) (

b) and (

c) is amended

(

a) by striking out " Transportation Safety Board Regulations, SOR 92-446 " and substituting " Transportation Safety Board Regulations, SOR/2014-37 ", and

(

b) by striking out "

section 4 " and substituting "

section 5 ".

Section 3 (2) is repealed and the following substituted:

(2) Subject to sections 1 and 2, the administration of the following provisions

is delegated to the agency:

(

a) the provisions of the Canada Transportation Act adopted by

section 7 of the adopting regulation;

(b) sections 16 (1), (3), (4), (4.1) and (6) and sections 26 (1), (3) and

(4) of the Railway Safety Act (Canada), adopted by

section 3 of the adopting regulation.
